vizio privacy class action lawsuit

VIZIO Inc. has agreed to settle a class action lawsuit alleging it advertised, marketed and sold smart televisions with the Amazon Instant Video app on the TVs when they didn’t actually have the capability to access the app.

If you bought a VIZIO television between Jan. 1, 2014 and June 23, 2014 but weren’t able to access Amazon Instant Video after you hooked the TV up to the internet, you may be entitled to benefits from this class action settlement.

Plaintiff Kirk Hinshaw alleges he purchased a VIZIO TV, but when he connected it to the internet and tried to use the Amazon Instant Video app, the TV displayed a message indicating the app was unavailable.

He says VIZIO misrepresented the availability of the Amazon Instant Video app and didn’t inform users that it would not be immediately available upon purchase.

VIZIO denies any wrongdoing but agreed to settle the smart TV class action lawsuit to avoid the expense and uncertainty of ongoing litigation.

Under the terms of the VIZIO class action settlement, Class Members will receive a pro rata share of the $2.3 million settlement fund in the form of a credit that can be used on the Amazon Instant Video website. These credits will be issued if the settlement receives final approval.

Class Members who wish to exclude themselves from the VIZIO smart TV settlement must do so no later than Oct. 11, 2016. If you would like to object to the VIZIO class action settlement, you must file your request no later than Oct. 17, 2016.

UPDATE: On Nov. 15, 2016, the VIZIO class action settlement was granted final approval. 

Who’s Eligible

Class Members of the VIZIO smart TV settlement include anyone in the United States who purchased a VIZIO television between Jan. 1, 2014 and June 23, 2014 and, after connecting the TV to the internet, were unable to access streaming content from Amazon Instant Video.

Potential Award

A voucher worth at least $4.99, in the form of a credit for use on the Amazon Instant Video website. The actual value of the voucher will be determined based on the number of accepted claims.

Proof of Purchase

Class Members must provide their VIZIO TV’s serial number on the Claim Form in order to be eligible for benefits.

NOTE: If you received notice of the VIZIO class action settlement by email, you will automatically receive a voucher with an access code and do not need to file a Claim Form. If you do not have an Amazon account, you will need to sign-up for one in order to receive your Amazon Instant Video credit.

    That’s it – $4.99! I bought a VIZIO smart tv because of the M-Go app and other features. The app kept saying “coming soon” but never came then my tv went out after a year and 8 months after purchase. Never got the app and couldn’t get the tv repaired. A $600 lost.
