EssureBayer HealthCare is facing a new Essure complications lawsuit, from an Iowa couple alleging the wife suffered severe injuries as a result of the permanent birth control device.

The couple is filing this Essure complications lawsuit against the pharmaceutical giant for failing to warn them against their product’s adverse side effects.

Plaintiff couple Andrea and Matthew B. filed this Essure complications lawsuit on July 15, 2016, after Andrea experienced various injuries in alleged result of the Essure.

According to the Essure complications lawsuit, the injuries Andrea suffered included uterine perforation, hepatomegaly and infection, each of which she alleges are linked to the defective nature of the Essure birth control.

Andrea opted to have the Essure birth control implanted after reviewing Bayer’s advertisements and discussed the decision with her physician.

At the time of the Essure implantation, her physician was not aware of the potential injuries she could suffer from the device.

In this Essure complications lawsuit, she claims that these complications were not listed on the product’s warning label, nor did the company provide any precautions or relevant studies.

Overview of Essure Birth Control Complications

The Essure birth control is currently the only non surgical female sterilization method available and was acquired by Bayer HealthCare soon after its release in 2002.

The device consists of two metal coils that are directly implanted into the woman’s fallopian tubes which eventually cause permanent sterilization.

The coils cause the tissue in the fallopian tubes to swell which blocks sperm to egg fertilization.

Ever since its release, Essure birth control has become increasingly popular among women in the United States.

As an alternative to the invasive and complicated surgery that is tubal ligation, women looking for a simple sterilization method have opted for Essure.

While this device has worked well for many women, it has caused just as many problems due to the alleged defective nature of the device.

Since its approval from the FDA, the agency has received over 4,500 Essure adverse event reports.

It has been pointed out that the Essure birth control was approved through the FDA’s fast review process, leading many consumer advocates to call for the device’s removal from the market.

Bayer HealthCare allegedly knew of these complications, but did not disclose them to protect the product’s market value.

Due to the alleged negligence of Bayer HealthCare, Andrea and her husband have had their lives permanently altered by Essure complications.

Matthew states that their marriage has been severely impacted by the Essure injuries, and is also filing for loss of consortium alongside the multiple counts of negligence in their Essure complications lawsuit.

This Essure Complications Lawsuit is Case No. 4:16-cv-487, in the U.S. District Court of Southern Iowa, Des Moines Division.

In general, Essure lawsuits are filed individually by each plaintiff and are not class actions.
