benicarA man has filed a lawsuit against Daiichi Sankyo alleging its blood pressure lowering medication Benicar caused psychological damage as well as multiple physical injuries.

Plaintiff Danny D. filed his Benicar lawsuit within the multidistrict litigation currently underway in New Jersey federal court where it joins nearly similar 1700 lawsuits currently in progress.

Danny is a 60-year-old man who began taking Benicar and/or Benicar HCT in April 2009.

As a direct result of taking Benicar/Benicar HCT, Danny alleges that he suffered the following personal and economic injuries: “nausea, abdominal pain, urgent diarrhea, bloody stool, weight loss, loss of appetite, dizziness, olmesartan associated enteropathy, symptoms and problems associated with irritable bowel syndrome.”

He also suffered “economic loss, psychological damage, need for medical monitoring, lost earnings and lost earning capacity, past present and future medical expenses, severe mental and/or physical pain, impairment, pain and suffering, emotional distress, loss of enjoyment of life” and more.

The plaintiff noted that Benicar caused psychological damage due to his pain and he suffered emotional distress.

Combined with his physical impairments, the psychological damage caused him to lose enjoyment of his life.

Multiple counts were brought forth against Daiichi Sankyo, Benicar’s manufacturer including: design defect and failure to warn, multiple counts of negligence, fraudulent concealment, negligent misrepresentation, constructive fraud, fraud, breaches of express and implied warranties, unjust enrichment, violation of Iowa consumer protection laws and punitive damages.

Danny is seeking a jury trial to obtain relief and judgment against the manufacturers of the medication and seeks compensatory damages, punitive damages, interest, costs of suit and any additional relief deemed proper by the court.

Benicar Side Effects

Benicar lowers high blood pressure in adults by dilating the blood vessels in the body to allow the blood to travel with less restriction through the vessels, causing less strain on the heart.

As with any medication, Benicar comes with known side effects which include joint pain, muscle and back pain, weakness, dizziness, itchiness, rash and upper respiratory infections.

More severe side effects are also seen with Benicar use, and the physical symptoms primarily involve problems with the gastrointestinal tract.

Chronic diarrhea, sprue-like enteropathy and villous atrophy are the most commonly reported conditions caused by Benicar use. Many related symptoms are associated with these conditions.

Villous atrophy and sprue-like enteropathy can also cause malnutrition by damaging the body’s ability to absorb nutrients.

With chronic diarrhea, patients may have such severe gastrointestinal trouble that they lose much of their nutrition and fluid caused by the uncontrollable diarrhea that occurs.

Patients may have to be hospitalized due to malnutrition and dehydration that results from Benicar diarrhea.

Benicar Caused Psychological Damage

Patients who suffer from severe Benicar side effects also state that Benicar caused psychological damage related to their physical condition.

For many that deal with chronic diarrhea, they feel fear of having uncontrolled bowel movements out in public and may socially isolate themselves and may even have to stop working.

By being in constant pain and being malnourished, patients taking Benicar may develop symptoms of depression, anxiety, may fear leaving the home and may lose the companionship of their spouse who becomes a caretaker in many instances.
