Unum Disability LawsuitA South Carolina resident has filed a lawsuit against Unum Life Insurance Company of America after receiving a disability insurance denial.

Plaintiff Alcides R. was employed with Costco Wholesale, and as part of his benefits package, he received long term disability coverage under a plan maintained by Unum.

The disability insurance denial lawsuit does not cite specifics, but says “Plaintiff became disabled because of certain problems from which he suffered, Plaintiff was forced to seize working and he filed a claim for long-term disability benefits.”

Following the claim filed by Alcides, Unum subsequently denied his claim.

After receiving the disability insurance denial, Alcides filed an appeal and exhausted all administrative remedies available to him prior to filing a lawsuit over his disability insurance denial.

“The Defendant’s decision was not based on substantial evidence or the result of the principled and reasoned decision-making process” the disability insurance denial lawsuit read. “Instead, the defendant’s decision was reached by Defendant ignoring relevant evidence pertaining to Plaintiff’s claim and, instead, relying upon biased information and flawed expert opinions.”

In addition to seeking the disability insurance payment for which he believes he is entitled, Alcides is also seeking attorneys’ fees and costs, pre-judgment interest on all benefits that should have been paid and any further relief deemed appropriate by the court.

Unum’s History of Disability Insurance Denial

Unum has somewhat of a reputation for issuing bad faith insurance policies. Essentially, consumers have claimed that the company has issued insurance policies with no intent of paying on the policies, at least without a fight.

This has led Unum to be the targets of many lawsuits by individuals who claim that they meet the disability requirements, have paid all premiums in full and have been denied their benefits despite allegedly meeting the conditions laid out by the disability insurance plan.

As far back as in the 1980s, Unum was accused of engaging in cash flow underwriting. Allegations claimed that the company sold many life insurance policies neglecting to consider the potential future risks of policyholders.

There were also allegations saying that Unum invested the money from disability insurance premiums and made profits off of those funds.

Once their insurance policies began to decline in value, Unum allegedly began denying benefits to qualified individuals under its plan.

The continued lawsuits filed against Unum suggest that these practices may still be in place.
