Mesothelioma-Wrongful-DeathA widow from Mississippi has filed an asbestos wrongful death lawsuit against several companies, including Electric Boat Shipyard and Ingalls Shipbuilding, claiming they all directly caused the death of her husband from mesothelioma.

Plaintiff Beatrice A., the wife of the deceased, brings this asbestos wrongful death lawsuit, accusing the defendants of gross negligence and claims that their actions in failing to protect Albert from harmful exposure to hazardous asbestos particles at his jobs led to his death.

Albert worked in the shipbuilding for nearly 53 years.  He was diagnosed with mesothelioma in 2013 and after one year of painful and sickening cancer treatment, Albert passed away on July 3, 2014 at the age of 74, the claim states.

According to the asbestos wrongful death lawsuit, Albert was employed at various companies since his high school graduation in 1958 where he was allegedly exposed to asbestos.

From July 1958 through Jan. 1984, Albert worked his way up the ranks from a drafting apprenticeship program to Senior Design Specialist at Electric Boat Shipyard. While he was employed at EBS, he was assigned the task of fabricating and installing shipboard structures for Navy ships.

In 1984, Albert moved to Mississippi and took a job at Ingalls Shipbuilding where his duties included boarding destroyers and cruisers and making routine inspections prior to overhaul work.

Shortly after his retirement from the shipyard industry in 2012, Albert began experiencing the inability to take a deep breath, weakness and coughing and trouble swallowing.

In May of 2013, he was diagnosed with mesothelioma, which ultimately took his life a year later.

Beatrice claims in the asbestos wrongful death lawsuit that each of the defendants knew or should have known through industry medical studies and reports the health hazard inherent in the asbestos containing products Albert was exposed too during his work in the shipyard industry.

She alleges that Albert never had reason to believe that asbestos exposure was life-threatening and that the defendants concealed the dangers of asbestos exposure.

Dangers of Asbestos Exposure

Though it has been established that exposure to asbestos can cause mesothelioma — and the greater the exposure to asbestos, the greater the risk that mesothelioma will crop up — mesothelioma isn’t the only health problem linked to asbestos exposure.

Exposure to asbestos fibers has been linked to lymphoma, asbestosis (scarring of the lungs that restricts breathing), lung cancer, and silicosis. The chances of getting an asbestos-related illness increase as the level and duration of exposure to asbestos increases.

Filing an Asbestos Wrongful Death Lawsuit

More than 600,000 victims have filed asbestos related lawsuits in the past few decades alone and asbestos litigation has become some of the most expensive and intricate types of lawsuits in the history of U.S. court cases.

Many of these cases were brought by the family of a person who was diagnosed with mesothelioma or an asbestos-related illness, and passed away either before or during a lawsuit. People who are close enough to the deceased can file an asbestos wrongful death lawsuit, provided they meet certain criteria.
