A woman has filed a Prilosec a lawsuit against AstraZeneca following complications that she experienced after using the heartburn medication.
Plaintiff Jackie K. used Prilosec for the treatment of peptic disorders, which encompass gastroesophageal reflux disease, more commonly known as GERD, nonsteroidal anti-inflammatory drug induced gastropathy and peptic ulcer disease.
The Prilosec lawsuit states that Jackie used Prilosec starting in about 2010 and used it through 2013. She began taking the medication at approximately 77 years of age.
As a result of her use of Prilosec, Jackie claims that the proton pump inhibitor (PPI) drug caused her to suffer from End Stage Renal Disease and other personal injuries that are permanent and lasting in nature.
In addition to these injuries, Jackie claims she has suffered physical pain and mental anguish, diminished enjoyment of life, lifelong treatment including medical monitoring and/or medications as well as the fear of developing future health consequences as a result of her Prilosec use.
Jackie’s Prilosec lawsuit states, “Defendants had received numerous case reports of kidney injuries and patients that had ingested Prilosec by as early as 1989.
These reports of numerous kidney injuries put Defendants on notice as to the excessive risks of kidney injuries related to the use of Prilosec.”
The lawsuit goes on to state, “However, Defendants took no action to inform Plaintiff or Plaintiff’s physicians of this known risk. Instead, Defendants continue to represent that Prilosec did not pose any risks of kidney injuries.”
Proton pump inhibiting medications, commonly referred to as PPIs, were introduced into the U.S. market in 1989.
Following their introduction, observational studies have been conducted.
These studies have shown that PPIs have been linked to a number of adverse health conditions, including open quote hip fracture, community acquired pneumonia, Clostridium dificile infection, acute interstitial nephritis and acute kidney injury.
Additionally, a study published in 2015 “shows that acute kidney injuries increased 250% in elderly patients that were newly prescribed PPIs.
Acute kidney injuries occurred within 120 days of the patients starting the PPIs,” according to the Prilosec lawsuit.
Jackie has brought forth multiple counts against AstraZeneca including negligence, strict products liability, breach of express warranty, breach of implied warranties, fraudulent misrepresentation, fraudulent concealment, negligent misrepresentation as well as fraud and deceit.
Jackie is seeking compensatory damages for past and future damages related to her pain and suffering and personal injuries as well as healthcare costs, punitive and/or exemplary damages in a sufficient amount to punish the defendant and deter future similar conduct, attorneys’ fees and costs and other further proper by the Court.
The Prilosec Lawsuit is Case No. 2:16-cv-2605, in the U.S. District Court for the District of Kansas, Kansas City Division.
In general, acid reflux medication lawsuits are filed individually by each plaintiff and are not class actions.
