Top Class Actions viewers are starting to receive checks in the mail from a class action settlement that accused Abercrombie & Fitch of violating the Telephone Consumer Protection Act.
According to comments and posts on the Top Class Actions Facebook page, Class Members who submitted timely and valid claims for the Abercrombie & Fitch TCPA settlement began receiving checks worth as much as $40.09 on Aug. 29, 2016.
If you filed a claim for the Abercrombie class action settlement, keep an eye on your mailbox because checks are on their way!
The TCPA class action settlement resolves allegations that Abercrombie & Fitch, Hollister, Gilly Hicks and abercrombie kids sent unsolicited text messages to customers without prior consent.
Plaintiff Anamaria Chimeno-Buzzi claimed the over the course of two months, she received 18 advertising text messages from Abercrombie & Fitch as well as Hollister.
According to the plaintiff, the messages were not sent with her permission nor did the company provide a way to opt out of receiving them.
Abercrombie & Fitch, and its subsidiaries, deny any wrongdoings but agreed to pay $10 million to settle the class action lawsuit.
Class Members included all U.S. residents who received one (or more) text messages sent by or on behalf of Abercrombie & Fitch Stores Inc., Hollister Co., Abercrombie & Fitch Co., Gilly Hicks and/or abercrombie kids from Aug. 25, 2010 through Dec. 18, 2015.
The deadline to file a claim for the Abercrombie & Fitch class action settlement passed on May 15, 2016.

This particular settlement is a TCPA settlement and applies to customers who received text messages. You’ll need to contact the settlement administrator with questions about your claim: https://www.aftcpasettlement.com/. Unfortunately, the toll free number is probably a recording. You may have to contact in writing. Or, you can try contacting class counsel with questions. Good luck!

I also received my check for $40.09 but is anyone else having a hard time depositing the check?
I saw the note on the check (it stated that the checks were not to be cashed at a check cashing agency or a “money service business”) so I didn’t try to cash it anywhere. I don’t have a bank account anymore, so I thought I would be stuck, unable to do anything with the check, but I have a prepaid card – Netspend, and I got an email about a mobile check load bonus they were doing through their app. So I was able to load the check onto my card using the Netspend app and my phone. It was easy, it took only a few minutes to get the money on my card, but they charge a fee of $5 if you want the money immediately. If you wait 10 days or til the check clears, there is no fee. So I could get my money from an ATM or spend it using my prepaid debit. This is an option if you don’t have another way.
