Settlements have been reached in a class action lawsuit filed against Halliburton Energy Services Inc., Transocean Deepwater Inc., and other related companies following the Deepwater Horizon oil spill in the Gulf of Mexico that occurred on Apr. 20, 2010.

Halliburton Energy Services Inc., Halliburton Company, Triton Asset Leasing GmbH, Transocean Deepwater Inc., Transocean Offshore Deepwater Drilling Inc. and Transocean Holdings LLC have agreed to pay more than $1.2 billion to settle claims stemming from the Deepwater Horizon oil spill.

The 2010 Deepwater Horizon oil spill resulted from a blowout of the Macondo Well, which led to explosions and fire on the Deepwater Horizon oil rig, causing it to sink. As a result, a massive amount of oil was discharged into the Gulf of Mexico over the course of several months.

The oil spill settlements provide compensation to Class Members who could have asserted claims for punitive damages and certain other claims in the 2012 BP Deepwater Horizon Economic & Property Damages Settlement (“2012 BP Deepwater Horizon Settlement”).

NOTE: These settlements do not offer compensation for economic loss or personal injury claims. They only cover claims for punitive damages. Punitive damages are intended to punish the defendants for their conduct and discourage them from committing similar acts in the future.

At trial, it was determined that the Halliburton and Transocean defendants did not commit gross negligence, wanton or willful misconduct. The court determined they were not responsible for punitive damages.

Even though Halliburton and Transocean weren’t liable for punitive damages, they agreed to these oil spill class action settlements to avoid the cost and risk associated with further litigation.

The proposed Halliburton class action settlement was filed in Louisiana federal court in September 2014. It was preliminarily approved on Apr. 12, 2016.

If you would like to opt out of or object to the Halliburton class action settlement, you must do so no later than Sept. 23, 2016.

Who’s Eligible

Two Classes that are eligible for compensation from the Halliburton, Transocean oil spill settlement: The New Class and the Old Class.

New Class: The New Class included Class Members whose property was physically oiled due to the Deepwater Horizon oil spill. This Class was created to address claims for punitive damages under federal maritime law, and includes groups that were previously excluded from or who opted out of the 2012 BP Deepwater Horizon Settlement. Under the terms of the Halliburton oil spill settlement, $902 million will be paid to members of the New Class who file valid and timely claims.

Old Class: The Old Class includes the hundreds of thousands of individuals and businesses who previously submitted claims for the 2012 BP Deepwater Horizon Settlement. Members of the Old Class are automatically included in the Halliburton, Transocean class action settlement.

      There have been no significant changes to the anticipated timelines for distribution for
      either Class. It is currently anticipated that Old Class distribution will occur in Summer 2018, while the New Class distribution is expected to take place 4-6 months after the DHEPDS determinations are all final.
