A settlement has been proposed in a class action lawsuit that challenges the lease agreements of Big Ten Property Management and TSB Holdings, which are entities owned by Tracy Barkalow.

If you were a tenant of Tracy Barkalow in Iowa City through one of these entities for the 2010-2011 and/or 2011-2012 lease terms, you may be entitled to compensation from this class action settlement.

A court has granted summary judgment in favor of the plaintiffs, ruling that certain provisions in the lease agreements were prohibited under the Iowa Landlord Tenant Act.

Specifically, the judge ruled that provisions removing the landlord’s liability, requiring tenants to pay for all damages to common areas, automatic carpet cleaning, and charging tenants other than actual costs and damages were prohibited.

Class Members must register to be eligible for payment from this class action settlement.

The registration/Claim Form deadline is Dec. 15, 2016.

Under the terms of the class action settlement, $10,400 will be dispersed to former tenants.

However, if fewer than 160 Class Members register for this settlement, the leftover money will be donated to charity or to the state of Iowa.

The Iowa tenants class action settlement received final approval on Aug. 17, 2016, just one month after the Iowa Tenants Project reached a settlement with Apartments Downtown, the largest property management company in Iowa City.

Who’s Eligible

If you were a tenant of Tracy Barkalow in Iowa City through his entities TSB Holdings or Big Ten Property Management for the 2010-2011 or 2011-12 lease terms, you are a Class Member of this settlement and you may be entitled to compensation.

Potential Award

Up to $130.

Under the terms of the Iowa tenants settlement, Class Members are entitled to receive $65 per year they were tenants during lease years 2010-2011 or 2011-2012. Class Members who were tenants during both lease years will be eligible to receive $130.

If there are more than 160 eligible claimants, the payments to tenants will be reduced proportionally.

Class Members must provide the street address and unit number (if applicable) where they resided during the 2010-2011 and/or 2011-2012 lease term.
