Essure Birth ControlA woman has filed an Essure injury lawsuit against Bayer alleging the pharmaceutical and medical device company failed to warn patients and physicians of the serious risks associated with its permanent birth control device.

Plaintiff Brenda M. says she consulted with her doctor regarding permanent forms of birth control, and he recommended the Essure device as an alternative to traditional tubal ligation.

According to her doctor, Essure was an easier procedure that could be performed in a physician’s office, was less invasive and required a shorter recovery time than tubal ligation and was very effective in preventing pregnancy, Deborah stated in her Essure injury lawsuit.

Essure consists of two metal coils that are designed to permanently prevent future pregnancy. The coils are inserted through the vagina into the fallopian tubes.

Once the coils are in place, the body naturally form scar tissue around the coils, blocking the fallopian tubes and thereby preventing fertilization of the egg.

In July 2009, Brenda underwent the Essure procedure. Shortly thereafter, she began suffering from “severe menstrual pain, severe lower abdominal pain and cramping, severe back pain, pain during intercourse, migraines, Vaginal infections and discharge, fatigue, headaches, and sharp pelvic pain.

Brenda sought medical attention for her complication, however, at the time, none of the doctors connected her symptoms to her implantation of the Essure device.

In November 2015, Brenda learned from other women online who had been implanted with the Essure device that they had had similar complications after undergoing the permanent birth control procedure.

Brenda has since visited her doctor to explore her options in having the Essure coils removed.

“The physical pain and emotional anguish that [Brenda] suffered as a result of these coils is a direct and proximate result of the Defendant’s failure to disseminate accurate information regarding the safety profile of their product,” the lawsuit states. “Without this information, [Brenda] was unable to make an informed decision regarding safer alternatives.”

Brenda has brought forth several accounts against Bayer including negligent failure to warn, strict products liability- inadequate warnings, negligence/negligence per se, breach of express warranty, negligent misrepresentation and fraud. She is also requesting punitive damages against Bayer.

The relief requested by Brenda includes economic and non-economic damages, compensatory damages, declaratory judgment against Bayer, disgorgement of profits, attorneys’ fees and costs, prejudgment interest and costs of suit, punitive or exemplary damages according to proof and any additional relief deemed proper by the court.
