The fresh potatoes class action settlement resolves allegations that numerous companies involved in the growing, packing, processing and marketing of fresh potatoes manipulated the supply in a scheme to inflate prices.

In addition, the class action lawsuit accused the defendants of working together to limit the number of potato acres planted each year as well as manipulating the supply of potatoes that were placed in storage following the harvest.

Class Members included anyone who bought fresh potatoes from retailers in Arizona, California, Florida, Iowa, Kansas, Massachusetts, Michigan, Minnesota, Nevada, New York, North Carolina, Tennessee, Vermont or Wisconsin between Oct. 14, 2004 and April 10, 2015.

The defendants denied the allegations but agreed to pay $5.5 million to settle the claims.

The deadline to file a claim for the fresh potatoes class action settlement passed on Oct. 16, 2015.
