benicar-side-effectsA man has filed a lawsuit as part of the multidistrict litigation against Daiichi Sankyo alleging that its antihypertensive medication Benicar HCT caused him personal injury.

Plaintiff Luther M., a 68-year-old Mississippi resident, began taking Benicar HCT in 2005, according to his claim.

In addition to the Benicar HCT and colonic injuries allegation, Luther claims he also suffered from serious gastrointestinal injuries “including but not limited to villous atrophy, sprue-like enteropathy, colitis, kidney failure, malabsorption, malnutrition, dehydration, atrophy and/or symptoms of diarrhea, vomiting, nausea, abdominal pain, and/or other related symptoms as well as medical expenses resulting from these injuries.”

Luther has brought forth a total of seventeen counts against manufacturer Daiichi Sankyo regarding his use of Benicar HCT and colonic injuries he suffered including product liability for design defect and failure to warn and multiple counts of negligence including negligent design and negligent misrepresentation.

He also includes multiple counts of fraud including fraudulent concealment, breaches of express and implied warranties, unjust enrichment, violation of Mississippi consumer protection law and punitive damages.

The plaintiff is seeking a judgment against the defendants and relief in the form of compensatory damages, punitive damages, interests, costs of the lawsuit and any additional relief that the Court deems appropriate.

Benicar HCT and Colonic Injuries

Benicar (olmesartan) is a medication used to treat high blood pressure in susceptible individuals. While it may be effective in lowering blood pressure, it certainly does not come without a list of potentially serious side effects.

Many of the side effects reported by Benicar users involve the gastrointestinal system. Many patients go to their doctors with symptoms of celiac disease, a severe allergy to gluten, which is a protein found in wheat barley and rye. However, testing shows that these patients do not have celiac disease.

Similar conditions are then diagnosed in the patient, including sprue-like enteropathy and villous atrophy. These two conditions affect the gastrointestinal functioning and can lead to malabsorption of nutrients.

The malabsorption can then lead to states of malnutrition and can cause systemic effects throughout the body.

Diarrhea is also very common in Benicar users. This diarrhea is not a transient, manageable condition. Rather, it is chronic, unrelenting and severely disrupts the life of the Benicar user.

Often times, patients are unable to work or participate in social activities due to the effect that the severe condition has on their lives.
