A second round of settlement checks has been mailed to Class Members who participated in the Higher One OneAccount class action settlement reached in 2014. Top Class Actions viewers are reporting that the checks are worth just over $14 and are arriving in small “envelopes” that resemble postcards:
According to a notice printed above the check:
“In 2015, you received a payment from the Higher One OneAccount settlement. As stipulated in the Settlement agreement, remaining funds are being re-distributed to Class Members who cashed their original check. The check below is your prorated payment from the settlement. Please cash or deposit within 90 days of the issue date or it will be null and void. Please visit www.OneAccountSettlement.com for more information on this settlement. Thank you.”
The Higher One OneAccount settlement resolved multiple class action lawsuits filed in 2012 that accused Higher One Holdings Inc., Higher One Inc., The Bancorp Bank, Wright Express Financial Services Corporation (now known as WEX Bank), and Taylor Capital Group Inc. of deceptively marketing the fees associated with the Higher One OneAccount.
Specifically, the class action lawsuits alleged that the defendants failed to disclose the refund disbursement methods available to students for their tuition and financial aid refunds. The plaintiffs also allege the defendants inadequately disclosed fees such as PIN-based transaction fees and ATM fees associated with Higher One accounts.
Defendants denied the allegations but agreed to a class action settlement to resolve the litigation and avoid the uncertainty of going to trial.
Payments were issued to valid claimants in April 2015. Viewers of Top Class Actions reported that they received checks worth between $8 and $270, depending on the fees they paid.
