Unum Life Insurance Company is facing a new claim denial lawsuit from a Nebraska woman claiming the insurance company had wrongfully denied her disability benefits.
According to the claim denial lawsuit, the woman met all requirements to qualify under Unum’s plan but still allegedly had her disability benefits denied by Unum.
Plaintiff Patricia J. had her disability benefits denied by Unum after she became severely disabled due to her osteoarthritis.
Patricia was previously a full time employee at Black Hills Corporation and would have been ideally provided short term or long term disability benefits by the insurance giant should the need ever arise.
Disability Benefits Denied by Unum
When Patricia was no longer able to work due to a medical condition, she claims her disability benefits were denied by Unum even though she had been employed at Black Hills for a sufficient amount of time.
She claims she qualified for benefits based on medical severity and income loss.
Patricia became disabled in August 2013 and filed her claim for long term disability benefits, citing her injuries included the following:
- Severe osteoarthritis in the hands, neck, and back
- Chronic pain in hands, neck, thoracic spine and lumbar spine
- Degenerative disc disease in the cervical, thoracic and lumbar spine
- Depression and anxiety
Before Patricia filed her claim, Black Hills terminated her employment due to her disabilities and recommended for her to file for long term disability benefits. Ever since her termination, Patricia has been unable to work or find work in a similar occupation due to her disabilities.
This means that Patricia has lost considerable income while incurring medical bills, making the disability benefits all the more important to her situation.
Even though Patricia followed all aspects of administrative procedure and included all relevant medical documentation relevant to her disabilities, Unum decided against giving her disability benefits.
According to her lawsuit, the insurance company extended the review process of her claim several times until being officially denied by Unum on April 01, 2014.
According to the insurance plan, the disability benefits denied by Unum would have been 66.67% of the income she had earned before becoming disabled with an approximation of $2,500 per month.
At this point, Patricia has exhausted all administrative options to claim her disability benefits and is filing legal action against Unum for allegedly illegally denying her claim.
In her claim denial lawsuit, Patricia states that Unum failed in its contractual duty to provide her disability benefits when she qualified for them and did not provide sufficient reason for the claim denial.
Patricia is seeking compensation for the disability benefits denied by Unum in this her claim denial lawsuit.
