essure lawsuit alleges essure complicationsBayer Healthcare is fighting a massive Essure birth control lawsuit filed by 90 women who say they have suffered damages from using Essure birth control.

Essure is manufactured by Bayer HealthCare and is promoted as a permanent, non-surgical form of birth control. Women who opt for Essure birth control assume it is safe and effective.

When Essure was first released on to the market, the medical community and patients alike considered it to be a breakthrough form of permanent sterilization for women and safer than tubal ligation.

Implanting an Essure birth control device is done during a non-surgical procedure. Two flexible coils made of metal and polyester are inserted through the vagina and are implanted in the fallopian tubes.

Within a few months, tissue begins to grow around the coils and blocks conception.

But the Essure procedure is not as safe as was once assumed. Many women who have opted for Essure birth control have complained of serious side effects such as bloating, rashes, allergic reactions, excessive bleeding, organ perforation, pelvic pain, miscarriage and ectopic pregnancy.

Both women and physicians claim that Bayer did not inform the public about the possible serious side effects from Essure birth control.

Essure Birth Control Lawsuit

Recently, 90 plaintiffs have banded together and brought claims against Bayer Healthcare for their Essure birth control complications.

They claim that Essure birth control had Conditional Premarket Approval (CPMA). This means that it was approved by the FDA though a fast-track review system.

However, the plaintiffs claim that the defendants failed to comply with the CPMA order and federal regulations. They say that because the manufacturers of Essure birth control failed to comply with the original Conditional Premarket Approval, it was invalidated.

Because of this, the product could not be marketed or sold to the plaintiffs.

The plaintiffs bring a host of claims against Bayer Healthcare. They allege that Bayer is responsible for failing to report and actively concealing perforations which occurred as a result of the Essure procedure.

According to the Essure birth control lawsuit, the plaintiffs hold Bayer responsible for failing to use pre-sterile and post-sterile cages, manufacturing Essure in an unlicensed facility and manufacturing it without a license to do so for 3 years.

The defendants are also accused of not reporting complaints in which Essure migrated, perforated bowels or broke into pieces. Plaintiffs say Bayer didn’t have a complete risk analysis for Essure birth control nor did it take into account any of these complaints while performing an analysis.

Among numerous other complaints, the plaintiffs claim that on May 30, 2013, the FDA uncovered an internal document that showed 16,047 separate complaints which were not properly reported to the FDA.
