birth-control-essureBayer is facing another massive Essure lawsuit, filed collectively by over two dozen plaintiffs who allege they were harmed by the company’s permanent female sterilization device.

This massive joint complaint claims that Bayer knowingly downplayed patients’ reports of Essure complications with the birth control implant.

Plaintiff Ashley B., a Georgia resident, has joined 26 other women and their loved ones across the country in filing the Essure lawsuit over injuries allegedly caused by Essure side effects.

Specifically, Ashley alleges that shortly after undergoing the implantation of Essure in Dec. 2014, she began suffering pain during intercourse, heavy bleeding, and weight fluctuations.

Moreover, despite being implanted with Essure for more than three months, Ashley learned she was pregnant and gave birth to a baby in Feb. 2016.  The baby was born with hearing loss.

The Essure lawsuit, filed on June 3 in Pennsylvania state court, also claims that Bayer marketed on its website that Essure is the “only FDA approved female sterilization procedure to have zero pregnancies in the clinical trials”.

However, according to the complaint, there were actually four pregnancies during the clinical trials and five pregnancies during the first year of commercial experience – information that was allegedly concealed from the plaintiffs.

What Is Essure?

Essure is a permanent birth control device for women. Approved by the FDA in 2002, Essure has been implanted in more than 750,000 women worldwide.

Its popularity can be attributed in part to Bayer’s aggressive advertising campaign, which touted the device as “the only non-surgical, permanent birth control available.”

The medical device is a four-centimeter, micro-insert that is placed in the fallopian tubes and prevents pregnancy by causing severe inflammation that is intended to create a total and permanent blockage of the fallopian tubes.

Essure’s micro-inserts are comprised of an expanding coil made of a stainless steel inner coil, a nickel titanium expanding outer coil and polyethylene (PET) fibers.

After placement of the coils in the fallopian tubes by Bayer’s disposable delivery system, the micro-inserts expand upon release and anchor into the fallopian tubes. The PET fibers cause inflammation in the fallopian tubes, causing scar tissue to form over the coils, thus blocking fertilization.

Essure Lawsuit Information

In response to Essure complications, thousands of women across the country have turned to social media to raise awareness of the controversy surrounding Essure.

For example, a Facebook community page called “Essure Problems” has more than nearly 5,000 likes and the “Essure Uncensored” page on Twitter has close to 1,500 followers.

Environmental activist and consumer rights advocate Erin Brockovich has also created a website to educate the public about the dangers of Essure.

Additionally, many women have opted to file an individual Essure lawsuit or like Ashley B., join a collective action seeking compensation for their Essure injuries.
