The Federal Trade Commission has reached a settlement over claims that Genesis Today, Pure Health and Lindsey Duncan falsely advertised the weight-loss benefits of green coffee bean extract.

These supplements were promoted on “The Dr. Oz Show,” “The View,” and other television programs. Duncan also advertised the green coffee bean extract supplements on his website, according to the FTC lawsuit.

The FTC accused the defendants of deceptively claiming that the green coffee bean extract supplements could cause consumers to lose 17 pounds and 16 percent of their body fat in just 12 weeks without exercising or dieting.

According to the FTC lawsuit, the defendants asserted that these claims were backed up by a clinical study. In September 2014, the FTC settled a lawsuit against the company that sponsored the study.

The FTC is mailing checks to consumers who purchased the green coffee bean extract supplements online. If you purchased the green coffee bean supplements in a retail store, you may apply for a refund.

“Lindsey Duncan and his companies made millions by falsely claiming that green coffee bean supplements cause significant and rapid weight loss,” Jessica Rich, Director of the FTC’s Bureau of Consumer Protection, said in response to the settlement. “This case shows that the Federal Trade Commission will continue to fight deceptive marketers’ attempts to prey on consumers trying to improve their health.”

UPDATE: “In June 2016, the FTC mailed full refunds to nearly 200,000 people who purchased the supplements online. UPDATE 2: On June 1, 2017, Top Class Actions viewers who filed a claim for the FTC green coffee bean extract supplement settlement started receiving checks in the mail. 

UPDATE 3: December 2018, the FTC is mailing a second round of checks totaling more than $2.5 million to consumers from the Green Coffee Bean extract settlement. 

Who’s Eligible

Consumers who purchased Pure Health or Genesis Today green coffee bean extract weight loss supplements between April 1, 2012 and June 30, 2013 are eligible to file a claim.

Potential Award

Full or partial refund.

Consumers who purchased the supplements online will receive a full refund, with the average check totaling $47.93. Consumers who file a claim may be eligible for a partial refund.

Proof of Purchase

Claimants must indicate the store from which they purchased the supplements and the amount they paid for the products.
