Philip Morris agreed to pay more than $15 million to settle a class action lawsuit that accused the cigarette maker of falsely representing Marlboro Lights as “safer” than Regular Marlboros.

The settlement amount reflects the court awarded $4.9 million, as well as prejudgment interest of $10.3 million.

According to the class action lawsuit, Philip Morris willfully violated Massachusetts consumer protection laws by using words such as “lights” and “lowered tar and nicotine” on packages of Marlboro Lights cigarettes.

The lawsuit alleged that Phillip Morris knew that Marlboro Lights didn’t have significantly lower tar and were therefore no less harmful to smokers than Regular Marlboros yet intentionally used deceptive wording that indicated otherwise.

Class Members include all Massachusetts, Connecticut, Maine, New Hampshire, New York, Rhode Island or Vermont residents who purchased Marlboro Lights regularly within the State of Massachusetts between Nov. 25, 1994 and Nov. 25, 1998.

If the settlement is granted final approval, Class Members who file a Claim Form will be unable to bring any further accusations against Philip Morris (and its affiliated companies) regarding Marlboro Light purchases made within Massachusetts.

Those who wish to object or opt out of the Marlboro class action settlement must do so by Aug. 19, 2016.

Who’s Eligible

Marlboro Lights class action settlement Class Members include all Massachusetts, Connecticut, Maine, New Hampshire, New York, Rhode Island or Vermont residents who purchased Marlboro Lights regularly within the State of Massachusetts between Nov. 25, 1994 and Nov. 25, 1998.

Potential Award

$75 – $225

Philip Morris has agreed to pay more than $15 million to settle the Marlboro Lights class action lawsuit.

Those who submit valid and timely claims will receive a equal share of the settlement up to a maximum of $225. If every Class Member files a Claim Form, the Settlement Administrator estimates that individuals will get about $75.

Class Members don’t have to include a proof of purchase but they must submit a Claim Form no later than Nov. 28, 2016 to receive benefit from this class action lawsuit.

    Why aren’t all states filing a suit against Marlboro light company? Why only certain states? Maybe us in Washington need to file a lawsuit?

        I have contacted them several times since I posted my comment in April and they do not bother to check into anything. My grandfather’s claim was valid as I watched him fill it out and I mailed it for him the next day, a week before the deadline and still no avail. There is something going on when the claims admin will not do anything for a person that filed a legitimate claim besides the phrase “we have no record of (insert persons name here) claim in our files”. I am completely furious over this issue for a claim that my grandfather was owed because the Phillip Morris company lied to him like millions of others and am denied any action on this matter.

        I tried to contact them as I have still not received my grandfather’s claim and the email I sent was sent back to me as undeliverable. Is there another way of contact as it seems that they have closed up shop and not sent out the claim he was owed.

    I submitted a claim several times, even finally received confirmation. Now they came back with some line about having sent me a form I never received. My daughter received her check without submitting additional information. Yet they found a way to not send checks to some using this bogus claim. Now you can’t contact them, even if they ever did bother responding to your email. The settlement issuer needs a suit against them for not following proper protocol in receiving claims and processing them correctly.

    My grandfather has yet to receive his check even though it is April 19th. I contacted the claims settlement administrator a week or two ago about why he did not yet receive it and they said they did not have a claim for him even though I sent it in before the deadline and I had all the documents of the claim photo copied for proof, alas still no response. So I guess if you legitimately filed your claim you are dealt a 50/50 chance by the administrator to see if they want to give you your legitimate claim or not.
