Elations joint supplement class action lawsuitTop Class Actions readers are starting to receive checks in the mail from a class action settlement that accused The Elations Company falsely advertising its Healthier Joints Daily Joint Supplement Drink as “clinically-proven” to improve joint comfort.

According to reader comments and posts on the Top Class Actions Facebook page, Class Members who submitted timely and valid claims for the Elations settlement began receiving checks worth as much as $59.72 on May 31, 2016.

The Elations class action lawsuit settlement resolves claims that statements made on the joint supplement drinks were false and misleading, in particular the “clinically-proven” to improve joint comfort claim.

Plaintiff Robert McCrary accused Elations of having no evidential support to back-up claims that the glucosamine hydrochloride, chondroitin sulfate and boron combination found in their supplement drink products could provide joint pain relief or improve joint health.

While Elations maintains that its advertising was not misleading, the company decided to pay $1.35 million to settle the class action in order to avoid the cost and risk of further litigation.

Class Members of the Elations class action settlement included all California residents who purchased Elations drinks or liquid supplements between May 28, 2009 and Aug. 31, 2015.

The deadline to file a claim passed on Dec. 30, 2015.

    Why is it only California is so litigious???? Why aren’t lawyers of other states helping people get money back through suits like these.

    Last Sept I moved out of state. I put in my forwarding but I havent gotten the settlements that I have seen being paid. I am guessing they didnt get forwarded. Is there anything I can do? This is one of them. Thank you for your help.
