blood thinner eliquisA woman from Kentucky who suffered an intracranial hemorrhage has filed an Eliquis lawsuit alleging the drug’s manufacturers failed to issue proper warnings.

Virginia H. is bringing this Eliquis lawsuit as the personal representative of plaintiff Patsy R. Virginia alleges Patsy was diagnosed with blood clots on the brain and took Eliquis to treat that condition.

Virginia says that Patsy ended up suffering a cerebrovascular accident together with an intracranial hemorrhage, a type of bleeding on the brain. She now argues that Patsy’s injuries are attributable to the Eliquis she took.

The Eliquis lawsuit names as defendants Pfizer Inc. and Bristol-Myers Squibb Co. The lawsuit says both of these companies were involved in the design, production and sale of Eliquis.

Both companies failed to properly warn about the risks of Eliquis internal bleeding, the lawsuit further alleges.

Eliquis is known generically as apixaban. It’s an anticoagulant medication used to treat and prevent problematic blood clots.

It’s commonly used to prevent stroke in patients with atrial fibrillation and to treat and prevent other clot-related injuries like pulmonary embolism and deep vein thrombosis.

According to the Eliquis lawsuit, the defendants have been promoting Eliquis as having certain benefits over the older drug warfarin, namely that Eliquis does not require regular blood testing or diet limitations, and that the same dose of Eliquis is suitable for all patients.

Yet both before and after Eliquis went on the market, say plaintiffs, the defendants knew about reports of Eliquis internal bleeding, including bleeding on the brain.

Virginia says the defendants failed to alert the public and the medical community to these side effects. She also accuses the defendants of failing to investigate the problems further.

Eliquis Lawsuit Questions Clinical Study

Virginia alleges one of the clinical studies used to earn FDA approval for Eliquis were conducted incompetently and in a way that calls into question the defendants’ trustworthiness. The study in question, known as the ARISTOTLE study, was conducted at a Chinese facility.

The lawsuit contends the contractors conducting the study fraudulently misrepresented some study results. The scientists allegedly covered up certain reported Eliquis side effects and failed to report one death.

She also says major dispensing errors went undocumented, and the scientists allegedly lost track of subjects for follow-up.

The FDA was made aware of the reported flaws in the study. In a February 2012 meeting and defendants’ executives, FDA representatives said the conduct of the study showed a pattern of “inadequate supervision,” according to the Eliquis lawsuit.

According to the Eliquis lawsuit, during the FDA approval process for Eliquis, one FDA doctor recommended that the drug’s warning label should mention the irregularities discovered in the ARISTOTLE study.

This Eliquis lawsuit raises claims for negligence, strict products liability, breach of warranty, fraudulent misrepresentation, fraudulent concealment, negligent misrepresentation, and violation of Kentucky consumer protection laws.

Virginia is seeking an award of damages to compensate for Patsy’s injuries, punitive damages to deter the defendants from similar conduct in the future, and reimbursement of attorneys’ fees and costs of the litigation.

The Eliquis Lawsuit is Case No. 5:16-cv-00127 in the U.S. District Court for the Eastern District of Kentucky, Central Division-Lexington Docket.
