Amerigroup Insurance company is the latest company to come under fire for sending unsolicited text messages to consumers.
The Telephone Consumer Protection Act (TCPA) prohibits companies from using an autodialer to send unsolicited text messages to mobile phones unless the company has the consumer’s consent to do so.
Even if a consumer is a customer of a certain company such as Amerigroup, that does not give Amerigroup automatic consent to send text messages to the customer.
Each customer must voluntarily opt in to a text messaging service offered by the company in order for the company to legally send that consumer any text messages.
Why Do We Need the TCPA?
Text messages are a relatively new form of communication, and like all communication avenues, text messaging is now a way to market goods and services to consumers.
Text messaging is unique in that every text message received and/or sent can cost the receiving consumer money, based on their mobile phone service plan.
Text messaging is also a more personal form of communication because the messages are received on an individual’s own phone.
With 96% of smartphone owners using texting, it would be easy to have our phones overloaded with spam text if the industry was not regulated.
When companies such as Amerigroup Insurance allegedly send unwanted text messages to customers who have not opted in to receive them, the importance of the TCPA is inarguable.
Guard Against Unwanted Text Messages
According to Dimension Data, 38% of business contact centers currently offer SMS texting, and 23% have plans to offer it in the coming year. By the end of 2016, 61% of company contact centers will offer support via text messaging.
The reason text messaging is gaining in popularity among businesses is because it has gathered momentum in both the personal and professional worlds.
More than one-third of business professionals admit they can’t go 10 minutes without responding to a text message, and 80% of professionals are texting for business purposes, according to eWeek.
Connect Mogul reports that 90% of text messages are read in under three minutes.
The texting population is not only big, but it’s eager, too. It’s no wonder companies are practically drooling at the thought of sending mass text messages to their customers.
Amerigroup Insurance Admits Great Success with Text Messaging
In May 2015, Amerigroup Washington announced it was pleased that so many people were scheduling annual physicals as a result of their texted reminders.
While Amerigroup insisted those customers had opted in to their text messaging service, several Amerigroup customers stated they were receiving those text messages without giving the company permission.
Consumers who receive unwanted text messages or spam text from companies could be entitled to $500 to $1500 per text sent, according to TCPA regulations. It is against the law for companies to send text messages to individuals who have not given the companies prior consent.
Right now, Amerigroup Insurance is being investigated for sending spam text. If you received a text message from Amerigroup Insurance without authorizing the company to do so, you could have a legal claim.
