Terminix TCPA Fax Class Action Settlement

A settlement has been proposed in a class action lawsuit alleging The Terminix International Company and The ServiceMaster Company violated the Telephone Consumer Protection Act by sending unsolicited fax advertisements promoting Terminix services that did not include information on how to opt out of the faxed ads.

If you have an Illinois fax number that was sent unsolicited fax advertisements from the Terminix office in Elmhurst, Ill., between June 1, 2014 and March 5, 2015, and you did not have an established business relationship with Terminix, you may be entitled to payment from the class action settlement.

The Terminix class action lawsuit was filed by plaintiff Greg’s Greater Chicago Chiropractic LLC, which alleges it received unsolicited fax advertisements promoting Terminix services, and that the faxes did not inform the recipient how to opt out of receiving future fax advertisements. The plaintiff claims that these faxes violated the Telephone Consumer Protection Act.

The defendants deny the allegations but agreed to settle the TCPA class action lawsuit to avoid the cost and uncertainty of litigation. The Terminix class action settlement received preliminary approval on March 17, 2016.

Class Members who wish to object to or opt out of the Terminix TCPA class action settlement must do so no later than June 20, 2016.

Who’s Eligible

Class Members include anyone with Illinois fax numbers who, between June 1, 2014 and March 5, 2015, were sent unsolicited fax advertisements from the Terminix branch office in Elmhurst, Ill., that did not include an opt-out notice, and who did not have an established business relationship with Terminix.

Potential Award

$179 (estimated).

The actual amount each claimant will receive depends on the total number of Class Members who file timely and valid claims. It is estimated that around 870 faxes were sent. If 870 valid claims are filed by Class Members, each claimant would receive approximately $178.92.
