A Mississippi resident has joined the Benicar MDL underway in New Jersey with her recent Benicar lawsuit against Daiichi Sankyo, maker of the antihypertensive drug.
Plaintiff Thalia L. is a 55 year-old woman who claims that her use of Benicar (olmesartan) led to personal injury as well as economic loss.
Since 2013, Thalia said she has been prescribed three forms of the popular olmesartan drug including Benicar, Benicar HCT and Azor.
Following her use of these drugs, Thalia stated that she suffered the following side effects of Benicar: weight loss, anemia, diarrhea, diverticulitis, gallbladder removal, vitamin D deficiency, abdominal pain and severe headaches.
As a result of her stated injuries, Thalia has brought forth a total of fifteen counts in her Benicar lawsuit against Daiichi Sankyo.
These counts include products liability for failure to warn and design defect, multiple counts of negligence including negligent misrepresentation and negligent design, several counts of fraud, breaches of express and implied warranties, unjust enrichment, violation of Mississippi state consumer protection laws and punitive damages.
Thalia is seeking a trial by jury and is seeking unspecified damages in her Benicar lawsuit.
Side Effects of Benicar
The side effects of Benicar are mostly confined to the gastrointestinal system of the body.
Many patients present to their doctors with symptoms that look like Celiac disease, a severe allergy to the gluten protein in wheat, barley and rye. However, they test negative for the condition.
Still, patients do show signs of similar conditions including sprue-like enteropathy and villous atrophy.
Both of these conditions can lead to poor gastrointestinal functioning including malabsorption that in turn leads to malnutrition and causes systemic effects.
Benicar diarrhea is also a serious side effect of Benicar.
Not just a run-of-the mill nuisance, Benicar diarrhea affects individuals socially since they often have to leave situations immediately or not go out with friends and it is economically damaging because many cannot hold down a job due to their incessant need to use the restroom.
Benicar Lawsuit Information
Patients like Thalia who have taken Benicar or Azor olmesartan products who have sustained personal injury have taken matters into their own hands and have filed lawsuits against the drug manufacturer.
Most Benicar lawsuit filings state that the Daiichi Sankyo failed to warn patients, physicians and the public about the serious side effects of Benicar.
The plaintiffs in the lawsuits seek damages to address the personal, medical, emotional and social injury they sustained as a result of taking Benicar.
If you developed side effects of Benicar such as villous atrophy, sprue-like enteropathy, chronic Benicar diarrhea or other gastrointestinal side effects, you may have a legal claim.
