A settlement has been reached in a class action lawsuit that alleges SandRidge Energy Inc., SandRidge Operating Company and Lariat Services Inc. violated the Fair Labor Standards Act (FLSA) and state laws by failing to pay employees overtime wages.
According to the SandRidge Energy class action lawsuit, SandRidge and Lariat are companies that engage in the exploration, development and production of oil and gas properties in the United States. The plaintiffs allege that the defendants maintained bonus programs for their hourly oil field employees but failed to include these payments as part of their regular rate of pay to determine the proper amount of overtime pay.
The plaintiffs also assert that the defendants knowingly caused employees to work “off the clock” and failed to pay them for the time it took workers to put on and take off their personal safety equipment. Further, the plaintiffs claim they were required to attend daily safety meetings that started 30 minutes before their shift, but they were not paid for their attendance at these meetings.
The defendants deny the allegations but agreed to settle the unpaid overtime class action lawsuit to avoid the uncertainty and cost associated with ongoing litigation.
Class Members who wish to object to the settlement must do so no later than June 12, 2016.
Who’s Eligible
Class Members of the SandRidge settlement include all SandRidge/Lariat employees who worked as a driller, derrickman, motorman and/or floorhand in Kansas or Oklahoma at any time from July 15, 2010 through June 10, 2013, or in Texas at any time from July 15, 2009 through June 10, 2013, who were allegedly unpaid for their attendance at pre-shift safety meetings.
The following two subclasses have also been certified:
- “SandRidge/Lariat employees who worked as a driller, derrickman, motorman, or floorhand at any time from July 24, 2011 through September 30, 2014, who earned bonuses that were not calculated into their regular rate of pay to determine their appropriate overtime rates; and
- SandRidge/Lariat employees who worked during a workweek as a driller, derrickman, motorman, and/or floorhand at any time from July 24, 2011 through June 10, 2013, who allege they were unpaid for attendance at pre-shift safety meetings.”
