Kelloggs-frosted-mini-wheats-bite-size-cerealTop Class Actions readers are starting to report receiving checks in the mail from a class action settlement stemming from allegations that Kellogg’s Frosted Mini-Wheats cereal is falsely advertised.

According to reader comments and posts on the Top Class Actions Facebook page,Class Members who submitted timely and valid claims for the Kellogg’s settlement began receiving checks worth as much as $11.44 on April 18, 2016.

Kellogg’s denied all accusations but agreed to settle the class action lawsuit to avoid the expense of further litigation.

Top Class Actions has been following the Kellogg’s cereal class action since 2012. The settlement resolves claims that the cereal maker deceptively marketed Frosted Mini-Wheats as able to improve kids’ attentiveness, memory and other cognitive functions to a level that wasn’t supported by clinical evidence.

Kellogg’s agreed to a settlement that was initially rejected by a federal appeals court over a discrepancy regarding the amount Class Counsel was set to receive.

An amended $4 million settlement was granted final approval several months later after a district judge overruled six objections from Class Members while finding the terms to be “fair, adequate, and free of collusion.”

Class Members of the Kellogg’s class action settlement included anyone who purchased Frosted Mini-Wheats cereal in the U.S. between Jan. 28, 2008 and Oct. 1, 2009. Under the terms of the settlement, Class Members were eligible to claim $3.81 if they purchased one box of cereal, $7.63 if they bought two boxes, and $11.44 if they purchased three boxes of Frosted Mini-Wheats.

The deadline to file a claim for the Kellogg’s Frosted Mini-Wheats class action settlement passed on Nov. 29, 2013.

    ettlement. Just found the paperwork. Claim No: 00282762 for myself, Betty Streger; and Claim No. 00282788 for Heather Gregory. Can you help me?

    I received my check, but its a weird check. Theres no signature line on the back to sign the check. The shipping address info is on the back of the check. I havent cashed it yet. I hope that doesnt cause any issues. Not sure if mine was mis-printed, or if they are all like that.

      Mines the same. Bank refused to cash it said its not valid. Manager refused also I just called the hot line and said try it again and it’ll work.
