Gucci America Inc. has agreed to settle a class action lawsuit stemming over allegations that the luxury retailer violated the Credit Card Act by asking and recording personal information of customers at the point of sale.
Lead plaintiff Jessica Manner filed the class action lawsuit claiming that Gucci asks for mailing addresses, phone numbers and email addresses without reason.
“There is no legitimate need for Defendants to collect this information from credit card customers in order to complete the credit card transaction. Instead, Defendants use the unlawfully obtained personal identification information for their own business purposes,” the plaintiff claimed in the Gucci class action lawsuit.
Gucci denies all allegations and any liability but agreed to the settlement to avoid the cost of further litigation.
Class Members who wish to be excluded from the Gucci settlement must do so by June 14, 2016.
UPDATE: On Oct. 14, 2016, a federal judge granted final approval of the Gucci credit card act class action settlement.
Who’s Eligible
Gucci settlement Class Members include all customers who were asked for their personal identification information during a credit card transaction that took place at one of eight freestanding, full-priced California boutique stores any time between Dec. 8, 2013 and Mar. 16, 2016.
Potential Award
Varies.
The Gucci class action settlement offers Class Members either a store voucher for 15 percent off any full-priced merchandise purchase transaction of up to $10,000 or a pre-selected gift item selected by Gucci.
The retail price of the pre-selected gift item will be between $40 and $120 and vary by store. Vouchers will expire six months after it’s received and can be used at the following California Gucci locations:
- San Jose (333 Santana Row, Ste. 1000)
- San Francisco (240 Stockton St.)
- Topanga (6600 Topanga Canyon Blvd.)
- Beverly Center (8500 Beverly Blvd.)
- Beverly Hills (347 N. Rodeo Dr.)
- Costa Mesa (3333 S. Bristol St.)
- Palm Desert (73-061 El Paseo)
- San Diego (7007 Friars Rd.)
