FedEx Office Class Action Settlement

By Mike Holter

FedEx Office settlementFedEx Office and Print Services Inc. has reached a class action lawsuit settlement resolving allegations it printed in-store receipts that showed too many numbers of customers’ credit or debit cards. If you made a purchase at a FedEx Office store between April 2009 and April 2010 using a debit or credit card, you may be eligible to receive a $50 FedEx Office Store Value Card from the class action settlement.

The FedEx Office settlement will resolve a class action lawsuit, titled Razmig Tchoboian v. FedEx Office and Print Services, Inc., et al., that alleges FedEx violated the Fair and Accurate Credit Transactions Act (FACTA) by printing credit/debit card receipts that show too many numbers on the card. The alleged FACTA violations occurred at FedEx Office self-service machines located in the store. The receipts from the kiosks allegedly displayed the first two digits and the last four digits of their debit card numbers, and were printed at FedEx Office retail store locations nationwide.

FACTA prohibits merchants from printing more than the last 5 digits of the card number or the expiration date on any electronically printed sales receipts in order to protect consumers from identity theft. Violating FACTA carries a penalty of between $100 and $1,000 per violation.

FedEx denies it did anything wrong and maintains the numbers it printed on the receipts did not put customers at risk for identity theft because they were not personally identifying numbers.

Class Members of the FedEx Office class action settlement include all U.S. consumers who can present an original or copy of a printed FedEx Office receipt printed between April 2009 and April 2010 displaying the first two and last four digits of their credit or debit card number.

Class Members that submit a Claim Form no later than February 2, 2013 will receive $50 FedEx store card that may be used at any FedEx Office location in the U.S. for the following FedEx Office Express Pay services: copy machines (black and white and color copies), facsimiles, computer rentals, Lapnet Stations, and Sony Picture Stations.

A Final Fairness Hearing is scheduled for April 8, 2013.

i,m not sure about the dates

  2. Holly Wrenn says:

The Joke is on us. No one keeps mailing receipts. This is a load of crap!

  3. Judy says:

I agree–receipts are maintained if you need them to file long-form but the average person doesn’t need to keep them. How about credit card stmt or bank stmt showing pymt to FedEx during that time period?

  4. Deborah Fochler says:

Are you joking? Who keeps receipts for copies or mailing packages for years?? Please. Where would you live if you kept all those papers? The house would be full. What a crock.

  5. Miss V says:

I think the terms should be re-written. Becasue who keeps a Fedex receipt from 4 yrs ago. Why require a receipt for such a small purchase. The lawyers sound like that want al the money for themselves. The case should be denied or re-written.

  6. Etienne says:

Everyone should write to the court and the lawyers in the case (the address and directions are listed in the FAQs section) and object to the terms because it is quite unreasonable to expect us to keep receipts for a trivial amount for over 3+ years. I know I will be writing to them. The more people who object the more likely the settlement terms can be changed.

  7. fs says:

this is a complete joke. what the hell were the lawyers thinking? guess they just wanted their own cut. no one EXCEPT business folks would keep their receipts, and they are barred from submitting anything. ridiculous!

  8. chris says:

who keeps receipts from that long ago? you’d have to be a an effin pack rat to keep that kinda crap! reasonable protocol for receipts is 6-12 months, than after that shred. this is a ridiculous lawsuit smh

  9. Tom says:

Terrible settlement. Who keeps receipts nearly 4 yrs old at self service machines at fedex office stores? Seriously! Only a select few w/ to much time on their hands and obviously no kids or life.

The Judge should reject this settlement. Requiring a receipt for small purchases nearly 4 yrs ago is an unfair burden.
