Appeals Court Upholds Blessing v. SiriusXM Class Action Settlement

SiriusXM settlementA federal appeals court on Thursday upheld a lower court ruling that approved a $180 million SiriusXM class action lawsuit settlement. The settlement resolves allegations that Sirius Satellite Radio violated antitrust law by raising subscription prices after it acquired its only competitor, XM Satellite Radio, in 2008.

The SiriusXM class action settlement was approved in August 2011 but has been delayed pending objections by some subscribers that claimed the settlement gave them too little and lawyers too much.

The U.S. Court of Appeals in Manhattan affirmed the lower court ruling on December 20, saying: “Competent counsel appeared on both sides, and settlement was reached only after contentious negotiations. Thus the district court did not abuse its discretion when it presumed the proposed settlement was procedurally fair.”

Class Members of the SiriusXM class action lawsuit settlement who terminated their service between 2009 and 2011 were able to receive a free month subscription to SiriusXM. The settlement also included a provision that Sirius would not change its subscription prices for five months, which ended in December 2011.

The case is Blessing v. SiriusXM Radio Inc., Case No. 9-cv-10035, U.S. District Court, Southern District of New York.

    I had XM Radio for years until they switched to becoming one company, I saw my rates increase. I paid the rates for a while but they kept changing the rates an increasing them and discontinued many of the channels I subscribed too.

    I bought a 2004 Monte Carlo that has XM in it and I still have the service, althought it it is now SiriusXM and I pay more. am I still entitled?

    why is there not a class action suit against general motors with thert dex coo antifreeze .it clogs up your heater core so you can not get heat.it is also bad onvarious other parts.it eats up plastic,rubber gaskets and radiators.search dex cool on line and you will see all the damage it can due.it turns into a gel and ruins the heater core so you get no heat. thanks wally

    I question why I am charged to have abill mailed to m home when they will not take m e-mail adress to e-mail me a bill. They want be to pay two dollars to have a bill mailed. Also, the calls go outside of the country and it is difficult to understand the what the representative is saying.
