One of the tipping points in multidistrict litigation (MDL) occurs when a federal judge approves a master complaint for plaintiffs to use. Women who have suffered from Lipitor type-2 diabetes side effects now have that option if they choose to file their Lipitor lawsuits in an MDL centered in U.S. District Court in South Carolina.
Many Lipitor lawsuits feature generally the same allegations. The Lipitor complications lawsuits allege that drug maker Pfizer Inc. knew, or or should have known, of the links between the statin drug and elevated blood sugar levels well before what has been called an inadequate warning label was introduced in 2012. It does not mention type-2 diabetes, but rather fasting serum glucose levels.
However, the new master complaint includes data not often found in other Lipitor diabetes lawsuits. That includes that during clinical trials Lipitor was known to cause elevated blood sugar levels at a rate three times higher than placebo, a fact that is supported by later studies that the drug maker could have used in adjusting its warnings regarding Lipitor type-2 diabetes side effects, according to Lipitor lawsuit lawyers.
The new master complaint notes that in both Japan and Europe, those specific concerns have been addressed. Instead, each new Lipitor lawsuit will note that the effects for women who use the drug to reduce cholesterol levels include a significantly higher risk of death and non-heart-related mortality. There is one other wrinkle found by the Lipitor lawsuit lawyer team that could help plaintiffs.
While legal questions regarding generic drug liability continue, at least one manufacturer is under the gun regarding type-2 diabetes side effects. One of the named defendants is Greenstone, which manufacturers “an authorized generic version” and that “upon information and belief … is a wholly owned subsidiary of Pfizer.”

In general, Lipitor lawsuits are filed individually by each plaintiff and are not class actions.
