SiriusXM Marketing Class Action Lawsuit

A new class action lawsuit claims SiriusXM improperly uses license and registration data to send marketing materials to consumers without their consent.
Plaintiff Randall Hall alleges in the SiriusXM class action lawsuit that the company is violating the Drivers Privacy Protection Act (DPPA) by gathering personal information about the buyers of certain used vehicles that come equipped with three months of free SiriusXM satellite radio. The company then takes their information and markets to them in an effort to gain new subscriptions.
So what’s the problem? According to the SiriusXM class action lawsuit, the marketing campaign would not be illegal if the consumer accepts the free trial and provides their information to the company for marketing purposes. The problem lies in the fact that SiriusXM is collecting car owners’ information without their knowledge and using it to market to them.
The class action lawsuit says SiriusXM’s marketing practices are being investigated by the Attorney’s General of 30 states. Hall also maintains that when he contacted SiriusXM and requested he be removed from their marketing contact list, that his request was ignored. Hall also claims that SiriusXM made it seem that he would be billed for services he never had, even though he never subscribed to the service.
The SiriusXM marketing class action lawsuit is brought on behalf of all consumers in the United States to whom SiriusXM mailed marketing materials or business solicitations, where such person’s name, address or the VIN associated with a purchased vehicle was obtained by SiriusXM directly or indirectly from a motor vehicle record and such mailing was made without the express consent of the person to whom the information pertains.
The class action lawsuit is alleging violation of the DPPA, which carries a $2,500 fine per violation.
