3 Day Blinds is facing a class action lawsuit accusing it of sending spam emails to consumers without their consent.
Plaintiffs Sonya Valenzuela and Tommy Purscelley filed the 3 Day Blinds class action lawsuit against the company on Feb. 15 in California federal court, alleging violations of California’s anti-spam law.
According to the class action lawsuit, 3 Day Blinds markets window treatment products and related services through large-scale, unlawful email campaigns that embody every abusive practice that California law prohibits.
“Defendant’s conduct reflects a calculated strategy: conceal its identity, evade filtering safeguards and induce unwary recipients to engage with advertising they did not request and would not otherwise open,” the 3 Day Blinds class action says.
Class action: 3 Day Blinds spam emails ‘spoofed’ to conceal sender’s identity
Valenzuela and Purscelley claim they each received spam emails from 3 Day Blinds, with misleading subject lines promising substantial discounts on window treatments.
The class action lawsuit alleges these promotions were not genuine price reductions but rather an evergreen pricing structure that reflects 3 Day Blinds’ ordinary course of business.
In reality, the company perpetually advertises the same “buy one, get one 50% off” structure as its standard pricing model, such that the phrase does not describe a discount from a bona fide regular price, the plaintiffs allege.
They explained that 3 Day Blinds’ spam emails were sent from “spoofed” email addresses to conceal the identity of the true sender.
The class action lawsuit claims 3 Day Blinds violated California’s anti-spam law in three ways: unauthorized use of a domain name, misrepresented header information and deceptive subject lines and contents.
The plaintiffs seek to represent anyone in the United States who accessed their email while in California and received a commercial email from 3 Day Blinds containing a falsified, misrepresented or forged domain name, header information or subject line within the past four years.
They are suing for violation of California’s anti-spam law and seeking class certification, $1,000 per email, fees, costs and a jury trial.
Last year, Blinds.com, a Home Depot-owned company, was hit with a class action lawsuit alleging it sent consumers emails advertising false discounts on window coverings.
