Bair-Hugger-750-with-Rolling-Cart-Pic-2A Baltimore plaintiff recently filed a Bair Hugger lawsuit against 3M Company, alleging that the company’s device was defectively designed and caused him severe and permanent injuries.

Plaintiff Nicholas M. filed this Bair Hugger lawsuit after suffering from a severe Methicillin-resistant Staphylococcus aureus (MRSA) infection allegedly due to the use of a Bair Hugger during his knee replacement surgery in 2013.

The lawsuit alleges that the use of the Bair Hugger device during surgery introduced contaminants into his open surgical wound, which led directly to the (MRSA) infection.

Because of the infection brought into the surgical wound, the plaintiff was forced to undergo two extra surgeries, according to his complaint.

These surgeries removed the knee implant and cleaned the infected area. These surgeries occurred less than eight months after his original knee replacement surgery.

Because of the infection and these surgeries, Nicholas has continued to suffer long after the surgeries were over, including having difficulty walking and limited mobility, according to his Bair Hugger lawsuit.

These permanent damages inflicted on him, allegedly by the use of the Bair Hugger device, prompted Nicholas’s to take legal action in filing a Bair Hugger lawsuit, alleging that 3M Company, the developer and manufacturer of the Bair Hugger device, failed to adequately monitor their product’s safety.

Bair Hugger Warming System Risks

The Bair Hugger lawsuit, and others like it, claim that 3M Company was aware of the Bair Hugger warming system’s unreasonably dangerous risks, but chose to conceal those risks from the public and the medical community.

Many of these lawsuits similarly allege that the company has been aware of their product’s risk of pathogenic contamination since at least 2009, yet has continued to aggressively market the product as safe and effective during surgeries.

While 3M Company claims that the Bair Hugger’s filtration system meets High Efficiency Particulate Air (HEPA) Standards, which require that the filter remove 99.97 percent of particles larger than 0.3 microns, it has been reported that the Bair Hugger can only remove less than 65 percent of these particles, according to the legal claim.

The risks of exposure to contaminants during surgery with a Bair Hugger exist for thousands of people, considering that more than 50,000 Bair Hugger units are in use across the United States, the Bair Hugger lawsuit states.

Bair Hugger Lawsuits

Plaintiffs involved in Bair Hugger lawsuits across the country allege that the Bair Hugger, used to keep patients warm during hip replacement or knee surgery, actually exposes patients to contaminants in the room by blowing hot air on exposed surgical sites.

The air currents sweep up and deposit bacteria from the floor, blowing them directly into the surgical site and allowing for severe infections which can cause permanent damage, say the plaintiffs in these legal actions.

Many injured parties are coming forward with allegations of the Bair Hugger product causing serious and sometimes permanent infection and injury during surgeries.

These plaintiffs hope to gain some kind of financial compensation in return for their physical, emotional, and financial suffering felt as a result of the use of the Bair Hugger product.

If you or someone you know has suffered from infection or injury after undergoing a surgery where a Bair Hugger was used, you may have cause to file a Bair Hugger lawsuit.

The Bair Hugger Lawsuit is Case No. 1:15-cv-03653-JFM, in the U.S. District Court for the Baltimore Division of the District of Maryland.

In general, Bair Hugger lawsuits are filed individually by each plaintiff and are not class actions.
