Aspen Dental Class Action Lawsuit

The Aspen Dental class action lawsuit was dismissed on March 27, 2015.

Aspen Dental, one of the nation’s largest corporate-dental chains, has been hit with a class action lawsuit accusing it of illegally owning and operating dental practices and of deceiving patients with aggressive sales pitches for expensive treatments after they’ve been lured in with promises of free exams and X-rays. Aspen Dental owns and controls 358 clinics across the country and markets to low-income patients that can’t afford dental care.

The Aspen Dental class action lawsuit was filed following a June 2012 report by PBS FRONTLINE and the Center for Public Integrity titled “Dollars and Dentists” that uncovered Aspen Dental’s practice of servicing patients who can’t afford a dentist and then allegedly locking them into debt. Some patients in the report also alleged they were overcharged and given unnecessary treatments.

The Aspen Dental class action lawsuit was filed October 18, 2012 by 11 patients across the country who accuse the company of violating laws in 22 states that require clinics to be owned by dentists actively performing procedures onsite. The laws are designed to prevent business interests from overshadowing those of patients.

Aspen Dental said Friday that the accusations in the class action lawsuit “are entirely without merit,” and that it provides support services to dental offices owned by local dentists.

“The dentists and staff at Aspen Dental offices around the U.S. provide access to high quality, affordable dental care for millions of patients,” the Syracuse-based company said. “Their singular commitment is to do what’s right for their patients.”

However, attorneys for the Plaintiffs say in the class action lawsuit that Aspen Dental trains the dentists and sets production goals for them, and accuse the company of illegally practicing medicine. They are seeking class-action status to cover potentially tens of thousands of current and former patients.

In 2010, Aspen Dental reached a $175,000 settlement with the Pennsylvania Attorney General’s Office over misleading information about discounts, consultations, financing and other promotions.

Plaintiffs in the Aspen Dental Class Action Lawsuit are represented by attorneys Brian Cohen and Jeffrey Norton.

    I made an appointment with Aspen in December 2023 for a consultation to remove me teeth and provide me dentures top and bottom. The gave me an itemized estimate but failed to explain that the bone in the bottom would have to be removed for full lower denture . So they explained to me that they would leave 5 of my lower teeth and provide me a lower partial. So when I returned for the procedure the original dentist was off five days so another dentist was to remove my
    Lower lower teeth so the partial could be fitted. The dentist dentist discovered that the first dentist made a mistake indicating witch teeth to remove as the upper and lower partial had already been made.
    So I had to wait for a 2nd partial to be made. I have been back to aspen numerous times concerning this matter and I developed sinus problems after the procedures done by Aspen dental. I returned to Aspen dental to address my sinus issues and also to why my dentures wasn’t fitting properly at that time Aspen
    dental informed me that I needed oral surgery to have the bone in my upper mouth partially removed and the bone in my lower mouth surgeryly removed .

    I got upper and lower Dentures through Aspen about 5 years ago. They are awful. And they hurt. And they were hella expensive. **PLEASE ADD ME TO LIST**

    I got upper snap dentures july 19,2022. My teeth keep falling out when i eat. They made another one and the same thing is happening. I can not take it any longer. They also made me a new bottom partial that will not stay in even after a dozen adjustments. It’s a long drive a couple times a week to have run over there 48 miles one way to drop the denture off to get fixed and then drive back to pick it up the same day. I have missed alot of work due to this. I have no confidence left. They cant seem to find the right inserts to hold them still from rocking either.

      I am having trouble with the one in Mt. Airy, NC. When I went in for free xrays and consultation, the office manager told me that my bottom teeth were needing work below the gum line. I only went in to have a filling replaced that had came out 2 days before. She was trying to pressure me into having over $6000 worth of work done. I told her that my insurance only paid $3000. She the told me that my only other option would be to have my front 8 teeth removed. I already had partials in the back. Now 2 weeks later, my gum is infected.

    Went in to aspen in deland fl to get tooth filled ..first was xrays and they made a plan up and said I needed new bottom partial thats 6 or 7 years old and got me a plan with care credit .for 4 thousand they got 940 .60 that day .
    16 days later they cleaned my teeth which they said tgey gave me toothpaste and mouthwash totaling 70 dollars on my insurance which refused to pay it so they took it from my care credit amount I never got any receipts until second visit and i had to ask for them ..i really couldn’t understand what was on there I had also told them on first visit I wanted a new upper denture the classic because mine were 28 years old …but had to do them before end of year as my insurance paid 100 percent of the classic and I didnt want more expensive set because my insurance want pay all for them ..well my third visit wasn’t until December where they did a scan thing on my old denture which they scratched and they did a gooey denture fit they scheduled me for a try on on Dec 27 and they are suppose to be done in 2 days they then tell me maybe they won’t be able to get them done ..but they did and what a horriable job of making teeth one tooth was longer .they fixed that the teeth are crooked and a little buck .I asked to have them remade and get classic as the grooves were bothing me .
    This was on jan 11th and was told they would have to refund them to insurance and rebill them and she knew that I would have to pay 50 percent as they changed my insurance from 100 to 50 percent so it would have cost me more for cheaper quality..and I brought this up to her on the 29th when I picked up teeth these were not the classic and she said you can refuse them but they had my 940 dollars so I needed up.haveing to pay the difference which was 674.60 …they still had they still had 266 .40 of my money that was left from care credit..I asked manager Margie I think is her name for my xrays and my refund and reciept of refund which she Said she couldn’t give me it would take 10 days ..I waited 10 days no refund called her office they said she’d call back and didnt so I called main office..they fefunded 196 dollars I asked where other 70.was she said it was for toothpaste and mouth wash when I had my teeth cleaned that I never recieved ..I dont use mouthwash so I know I never got it that was 2 months before ..I got a notice from insurance thry didnt pay something but it didn’t say what .
    I called insurance they Said it was doubled billed so I didn’t think about it and it ended up being toothpaste and mouthwash ..I called them back about this charge and said it stated on doctor wrote it down he gave it to me so she said she couldn’t do anything for me ..so I have teeth I hate and no one at aspen drland would call me back snd I had to pay 181 folders to go to my old denist who I trust as hes not in my network to get my tooth filled because they never made me another appointment to fill tooth and my old denist said my teeth needed cleaning that I had done 6 weeks prior ..

    Aspen Dental in Lynchburg Va. They use the cheapest of materials. The quality is poor . They’re cutting cost corners and taking advantage of customers by not providing a satisfactory product. They lie and get over on their customers. They won’t answer your questions or the phone 99.9 % of the time. This company needs to be investigated for their theft of their customers and then prosecuted and shut down.

    Just go to Affordable Denture. They do good Work SAME DAY USUALLY! Some Aspen Locations need to be CLOSED Down due to False Business Practices and NON DISCLOSURE ISSUES among other things! False Advertising! The Receptionist is extremely Rude and UNCARING! They hang up on you and DO NOT RELAY Requests for Call Backs from the District Manager! The List goes on and on! Also this Location has been IGNORING ME since September! They have me in a CHOKE HOLD and I can’t even finish the Work I need done until the Bill is cleared which is exactly the amount of my Insurance Benefit! I will not pay that because I do not owe it! They had NO DENTIST FOR SEVERAL MONTHS but still pulled me in! It’s just a DISASTER! Even the Office Manager walked out and QUIT!

      I need teeth and I got them financed through Aspen Dental they canceled two appointments on me cuz the doctor didn’t show up and I rescheduled one now they will not make me an appointment they want me to come and drive 2 hours and said all day and maybe they can see me but they’ve already got the money from the finance company and they won’t give me an appointment

    I have had horrible service for financial needs with Aspen Dental. I have two insurances, one of which covers what I had done, up to $2000.00. My other insurance covered too. Instead of sending charges to the insurance that covers 100%, they send it to loan that I took out for uncovered charges. The $2000.00 they could have used is still available and will end December 31st. I had to call them many times to reimburse the loan for charges, before they finally did that. Now I am worried they will not send claim before $2000.00 insurance is gone at end of December. They threatened me that if they reimbursed loan, I would not be able to use loan for remaining balance and will owe them the money instead. I have a feeling that they will not send the claim to my insurance before deadline of December 31st. Here it is, already December 26th and would you know, their office is still closed for Holiday.

    Aspen dental fraudulent work, and not willing to return my money for services rendered. My first visit was x-rays and teeth cleaning and this was free due to my insurance at the time Blue Cross Blue Shield. They came up with a plan that I needed three crowns and an upper and bottom partial. My first visit to them was in January 2022 after the crown work was done it took about eight weeks to get my partial, the first time the partial broke a tooth came out while I was eating a sandwich. I had to go back and give them the partial so they can have it fixed two weeks later the partial broke again this time where two teeth were I had to wait for them to be returned again when they were returned they were not right, so I had to bring my old set in . So they can compare where the metal went in the back of my mouth. Finally after waiting for three weeks I was excited to go pick up my partial that same day at 12 o’clock the crown that they had just put on a year a little over a year earlier fell out, of course I was a little distraught about this so I keep my appointment to pick up my partial and show them that my crown had fell out. They told me that part of my tooth fell out with a crown so I will now have to get a root canal and another Crown . And which I replied, are you going to pay for the root canal and a crown? They told me they would give me a discount on the crown, but they would not run my new dental insurance that they would pay half of the cost as a crown, but I would have to pay the other half out of my pocket and they said the root canal was $138 and that they would go go ahead and set me up an appointment. I had another Aspen who did root canals there after I went to go pick up my partial not even two minutes later I went back in because I forgot my crown the receptionist went back to the back came back five minutes later told me the room has already been clean and they don’t know where the crown went to , so I wasn’t able to get the crown back now since I called up there they’re saying that I had a bad attitude and dismissed me from the practice . Since then I have emailed the CEO I have toxic customer service and haven’t received a response yet. I intend to have Aspen dental pay all dental bills from here forward from all the work they have done .
    The total I pay them was over $7700 and now I have to start all over with the whole process. Aspen is a joke.

    I have a serious problem with ASPEN DENTAL in Longview Washington.
    I flossed my tooth, a piece broke off, on the tooth that held my partial that I’ve had for 22 years. So… they pulled my tooth. Which caused my partial not to fit. So went in the garbage. So now I’m fitted for a new partial. Ever since I have not been able to eat anything unless it’s soft. No meat, no fruit, no raw vegs. I have Graves disease and need to eat the right foods. I went in crying 2 weeks ago, had to sit there and wait, crying. I was told I have to wait because others have checked in already. Then 2 others came into the office, they weren’t checked in yet.. but got to go back before me. My husband l9st his job, now no insurance, so now we have no way to finish the work they say I need, just to get my permanent partial. I told then last time I wish I would never have come into ASPEN DENTAL. Please contact me. I need help getting my permanent partials. Thank you so much.
