androgel-lawsuitAndroGel maker AbbVie was hit with lawsuit by a man alleging that the testosterone gel therapy product caused him to have a stroke.

The AndroGel lawsuit is part of the bigger testosterone therapy multidistrict litigation that is currently underway in an Illinois federal court.

Plaintiff Donald W. began taking AndroGel on Dec. 21, 2010 and suffered a stroke two years later on August 1, 2012.

Donald brings forth 11 counts against the drug manufacturer in the AndroGel lawsuit including strict liability design defect and failure to warn, negligence, negligent misrepresentation, breaches of express and implied warranty, fraud, redhibition, consumer protection, unjust enrichment and punitive damages.

The Testosterone Product Lawsuit is Case No. 1:15-cv-09602 in the U.S. District Court for the Northern District of Illinois and is part of the Testosterone Product MDL In re: Testosterone Replacement Therapy Products Liability Litigation, MDL No. 2545, in the U.S. District Court for the Northern District of Illinois.

Testosterone Replacement Therapy MDL

A multidistrict litigation, or MDL, is formed when there are multiple plaintiffs with the same concerns about the similar or same products. In this case, several testosterone products and their respective manufacturers, including the one used by Donald, are represented in the low-t drug MDL.

The products covered under this MDL include AndroGel, Testim, Axiron, Depo-Testosterone, Androderm, Testopel, Fortesta, Striant, and Delatestryl, though others not mentioned but with similar issues may be considered.

An MDL is formed to assist in conserving resources. All lawsuits are heard in a single court under one judge. Pretrial hearings and discovery are conducted all at once rather than before each individual trial.

With one judge presiding over the cases, the rulings and outcomes are more consistent, and the whole process is more streamlined and less time-consuming than if each case proceeded individually in courts across the country.

Testosterone Side Effects

Testosterone therapy, also known as low-t therapy, is used to treat hypogonadism in men, a condition where the sex glands may not be producing adequate amounts of male sex hormones.

After men reach the age of 39, levels of testosterone naturally begin to decline. Using supplemental forms of testosterone to boost levels can assist men in reclaiming optimal function.

Testosterone products comes in many forms, such as oral medications, injection, gels, creams, patches and subcutaneous implants. Many men may benefit from this therapy, but for others, the side effects may leave them worse off than when they began treatment.
