benicar-pain-woman2A Texas woman filed a Benicar lawsuit, joining the multidistrict litigation (MDL) against Daiichi Sankyo, alleging she suffered severe side effects.

Plaintiff Linda W., 67, began taking Benicar (olmesartan) in August 2005. As a result of taking the drug, the lawsuit alleges that she suffered severe and chronic diarrhea, diverticultis, olmesartan associated enteropathy, severe pain.

Linda brought 14 counts against the manufacturer including design defect and failure to warn, negligent design and negligent misrepresentation, fraud, breach of warranties, and unjust enrichment.

The plaintiff is seeking compensatory damages, punitive damages, interests, costs of litigation and other relief deemed equitable and just by the court.

The Benicar Lawsuit is Case No. 1:15-cv-08020-RBK-JS, as part of the Benicar MDL in the U.S. District Court for the District of New Jersey, Camden Vicinage.

Benicar Side Effects

Benicar is used to treat high blood pressure. Some users report experiencing severe side effects.

The majority of serious side effects are gastrointestinal. Benicar diarrhea is a common side effect, with patients experiencing a frequency of this side effect about 10 to 20 times per day. Severe abdominal pain is also common.

Patients frequently visit their doctor to obtain relief from these unrelenting symptoms, and often the doctor suspects Celiac disease, a autoimmune condition in which individuals have a severe reaction to the gluten protein found in wheat, rye and barley.

Despite having Celiac symptoms, Benicar patients usually test negative for Celiac disease but are diagnosed with a similar condition called sprue-like enteropathy. Many patients may also experience a degenerative condition in the small intestine called villous atrophy. With villous atrophy, the villi (small finger-like projections in the small intestine) are flattened, which can lead to chronic malabsorption and malnutrition.

Benicar Lawsuit Information

Over 1,100 Benicar lawsuits have been filed against Daiichi Sankyo. Because of the large volume of cases, the Judicial Panel on Multidistrict Litigation (JPML) created the Benicar MDL to address the lawsuits in a more timely and efficient manner since the lawsuits are against the same defendant and share similar allegations.

Under the MDL process, discovery and pretrial proceedings take place at the same time under a single judge. As the trials proceed, there is more consistency of rulings.
