Samsung washing machine mold class action lawsuitConsumer Robert Durso alleges in the Samsung washing machine class action lawsuit that Samsung markets its washers as “highly-rated, top-of-the-line appliances,” convincing consumers to pay more for Samsung products than those offered by competitors, even when those products have similar features. However, multiple Samsung washing machine models “fail to perform as advertised,” the class action lawsuit says, due to a number of defects, including that they:

  • Cannot accommodate large-sized loads as promised
  • Fail to clean clothes and remove stains as promised
  • Frequently display “error messages” to the user
  • Leave mildew smells within the washer and on the clothes that were just washed
  • Have frequent instances of premature failure of the pump
  • Collect “pot metal” in the hose
  • Have leaks and damage clothes due to premature disintegration of the rubber inside the washer

 

The Defects render the Washer unusable because they (1) fail to properly clean the clothes, (2) leak water in and around the Washer causing damage to the surrounding area, and (3) require continuous costly and inconvenient repairs,” the Samsung washer class action lawsuit states.

The lawsuit claims Samsung is aware of these defects, but continues to sell the washers and refuses to properly address and rectify the problem or to reimburse customers for damaged clothes, surrounding areas or for repairs, citing expired warranty periods.

The defective Samsung washing machine class action lawsuit is brought on behalf of all U.S. residents who own, or have owned, Samsung washing machine models WF331ANW, WF1124XAU, WF328AAW, WF209ANWXAA, WF218ANWXAC and/or any other Samsung washer model containing these defects.

It is seeking damages, restitution and disgorgement of profits for the proposed Class for violations of the New Jersey’s Consumer Fraud Act, fraudulent concealment/nondisclosure, breach of implied and express warranties, and negligent misrepresentation.

The case is Robert N. Durso v. Samsung Electronics America, Inc., Case No. 33-av-00001, U.S. District Court, District of New Jersey. The Plaintiff is represented by the law firms Nagel Rice, LLP and Michael S. Kasanoff.

UPDATE 1: On Nov. 4, 2013, a federal judge trimmed several claims from the Samsung Washer Defect Class Action Lawsuit, but denied Samsung’s motion to dismiss it entirely.

UPDATE 2: The Durso case was consolidated with several other Samsung washing machine class action lawsuits. The consolidated class action lawsuit was dismissed on April 2, 2014.

    I have to samsung flex washing machines both have the top balance weight bolt on the left side snap and right side just fall out ripped the seal on both and put concrete in the washing drum. They charge a rediculouse amount of money for these machines and that is 2 that i own that have the same issue.

    The balance weights shattering are a huge problem with these washers. People think its a drum bearing etc and throw them out….a little tip…You can go buy a bag of quick set concrete and throw a little gravel in it and you can refill the plastic shrouds and taaddaaa. You have a much better quality balance weight for about $5. I repaired mine 4 years ago when they shattered 11 days out of warranty and I havent had a problem since

    Just had mine brake but its worked for years. I would like to ask if you all know for sure if the shipping bolts were taken out? If not that might cause the premature failure of that arm. Good luck to all!

    According to 3 different people who check my washing machine, Samsung has a balance weight of plastic full with sand/concrete. You can see below your machine the sand when this piece brokes. This happen to us before the 1year warranty was over; however, we cannot change to other brand because our dryer, that we both with that washing machine, it’s not compatible with other brands to stack.

    Spider arm disentegrated. Clothes didn’t seem to be clean enough and aI would have to leave the door of the washer open. When close and reopened, there was a mildew smell.

      My WF306LAW/XAA model has metal in drain, found spider arm is broken.
      Looking for replacement part and can’t find any. Sumsung discontinued part so basically I have a 100lb door stopper
      If anyone can locate the correct part please let me know at email below!!

    Add me to the list. My front loader is less than 2 years old. The drum bearing is shot, washer walks all over. Repairs would be $1,800 to fix it. I will never buy Samsung again. Why aren’t they being held accountable.

        I am having the same issues but I also have an issue with the basket it came off the y mount! The repairman said the reason I have the problem is because the washing machine is no good! He said I was lucky not to have a other issues prior to now. Is there any help for us? I saw the first class action lawsuit against them but I can’t find any results on it

      Mine is 2 years old. I have replaced the rid springs 3 times with no luck. Will nit finish a load. I found mist gave the same issue. I will never ever buy samsung appliances again.

    I have had the same problems as read above. WF419AAW model. I replaced the spider are myself last summer. It disintegrated. It was not an easy job to do by yourself but I did it. Now this week the drum was loud and not spinning. I just got through taking it apart and sure enough the spider arm is broken. It’s not disintegrated but the shaft came completely separated from the spider arm. I sit here trying to decide to replace the spider arm again and spend $200.00 or just go by a different brand washer and dryer.
