Porsche Cayenne Class Action Lawsuit Moves Forward

Porsche CayenneA nationwide class action lawsuit regarding the cooling system in Porsche Cayenne vehicles continues to plod its way through court after U.S. District Judge Gregory Frost applied the law of 11 states to the consolidated case. Claims included in the consolidated Porsche Cayenne class action lawsuit now include consumer statutes, warranty claims, unjust enrichment and various tort claims.

Consumers in the 2011 Porsche Cayenne class action lawsuit allege they purchased a Cayenne that came equipped with defective plastic coolant tubes that cracked, leaked or otherwise failed after the four-year warranty period, causing engine coolant to leak into the engine, potentially leading to significant engine damage. The class action lawsuit alleges Porsche knew of the defects and that using the plastic material for the coolant tubes “virtually guarantees” they would prematurely fracture.

Plaintiffs in the Porsche Cayenne class action lawsuit allege that when they attempted repairs, Porsche did not offer replacement plastic tubes, but instead offered an “OEM update kit” that contained aluminum coolant pipes that cost between $1,500 and $3,600 per vehicle.

The Plaintiffs argue that the Cayenne’s coolant system was inherently defective and that the use of plastic coolant tubes “implicates serious safety concerns.”

Class Members of the Porsche Cayenne class action lawsuit include any one who owns or purchased a 2003-2008 Porsche Cayenne model with plastic coolant pipes. Judge Frost has not yet certified the class. Plaintiffs in the class action lawsuit are asking the court to force Porsche to recall all Cayennes with plastic coolant tubes and fix the problem by replacing them with aluminum tubes (or a stronger alternative). They are also seeking money damages to compensate the proposed Class.

The case is In re: Porsche Cars North America, Inc., 2012WL2953651, U.S. District Court, Southern District of Ohio.

    Had a sudden coolant level low warning come on a week ago on my 2008 Cayenne Turbo with 63,300 miles. Was able to pull over immediately and opened hood. Noticed a fine spray pattern of coolant at the firewall. Filled reservoir with water and it did not leak out anywhere. Proceeded to drive for less than 1/2 mile when the low coolant warning light came on again. Pulled off the road immediately and opened hood. This time the coolant was gushing out from underneath the driver side and there was a strong smell of hot coolant. Adding any water to the coolant tank immediately drained out underneath the drivers side. Had the car towed 120 miles to my dealership at an out-of-pocket cost of $575. Dealership inspected the car and found a defective cooling manifold or cooling console as they like to call it. There was a a press fitted fitting together held in place the cooling line with epoxy which had failed and caused the cooling line to be separated. The repair required the engine and transmission to be dropped in order to replace this cooling manifold. The repair came out around $4,400 but was covered under my third party extended warranty (Fidelity) after paying my deductible of $250. If Fidelity is not already aware of this potential class action lawsuit perhaps they should be informed in order to reclaim their loss. I would like to have my towing costs and deductible reimbursed through this class action lawsuit. I find that this is irresponsible by Porsche to have such a poor design in using a press fitted fitting for a critical component on an aluminum engine and cooling manifold. If it was a $10,000, third world developed car perhaps one could understand such a failure – but this is a $120,000 Porsche, that was supposed to have been refined and developed through Porsches many years of racing experience. Porsche should not be making such elementary mistakes and really needs to step up to the plate to make it right for their customers.

    Just picked up my 2008 Cayenne S (49k miles) from mechanic, severe coolant leak, pipes failure. First leak had happened back in 2009 or 2010 with less than 18k miles, dealer had assured me it wont happen again. No mention at the time about faulty plastic pipes replacement. Porsche Inc should be ashamed. $2,000.00 later I have brand new OEM aluminum pipes. I want to join lawsuit, need help with contact info. Thanks

    2006 Cayenne S Titanium Edition 86k miles. This problem occurred over a month ago. Dealer said they’d fix it, they just didnt say how long it would take them. They say they have to order the parts from porsche. This means Porche will now give them aluminum pipes, right?? First month with this vehicle and of course it had to happen, just glad it happened now and not in the future. Wouldn’t want to pay for parts myself. Still waiting to get my vehicle back btw.

    I just had my plastic cheap pipes gone about a week ago. I have spent over 500 on towing alone and have not replaced the pipes yet. By reading all the threads here I attest that at the dealer do not have anything recalled yet as today Nov 9 2013. So myself being a mechanic will do the repair which is not going to be fun either. Hopefully this legal action goes through soon. Thanks every one for all the detailed information given here. It gives me a really good idea of what to do with the repair I am about to do now.
