Jiffy Lube Franchisee Agrees to Text Spam Class Action Settlement
By Mike Holter
A Jiffy Lube franchisee known as Heartland Automotive Services has agreed to a $47 million class action lawsuit settlement to resolve allegations it spammed millions of consumers with text ads for discounts. If approved, the class action settlement will provide Class Members discounts of around $17 for any Jiffy Lube service.
Plaintiffs in the Jiffy Lube/Heartland class action lawsuit accused Heartland of violating the Telephone Consumer Protection Act (TCPA) by sending unsolicited text messages advertising a “1 time offer” for 45% off an oil change. The Jiffy Lube text spam messages were sent to 2.3 million consumers in April 2011. The TCPA requires companies to obtain users’ express consent before sending text ads. Companies that violate the TCPA are liable for a $500 fine per violation.
The proposed class action lawsuit settlement will require Heartland to offer consumers Jiffy Lube service discounts of around $17, as well as agree to an injunction banning it from sending unsolicited text ads.
Details on how to file a claim for the Jiffy Lube text spam class action settlement have not been released. Keep checking Top Class Actions or sign up for our free weekly newsletter for claim filing instructions once they are available.
