PNC BankPNC Bank agreed this week to pay $90 million to settle an overdraft fee class action lawsuit that’s part of a multi-district litigation involving more than 30 banks nationwide.

At least 13 other banks — including Bank of America, JPMorgan Chase, Union Bank and Citizens Bank — have reached class action lawsuit settlements in the case, In re: Checking Account Overdraft Litigation, which accuses the banks of reordering debit card and ATM transactions from highest to lowest, rather than in the order the transactions occurred, in order maximize the number of overdraft fees they could charge a customer.

PNC reached a separate class action lawsuit settlement regarding improper overdraft fees last year, in which it agreed to refund customers nearly $12 million in unfair overdraft fees.

A lawyer for the Plaintiffs in the current case says he anticipates the new settlement with PNC to be presented to the Court for preliminary approval later this summer. At least “several hundred thousand” PNC customers throughout the country who were overcharged for debit and ATM overdrafts between 2004 and 2010 will be covered by the PNC class action settlement.

The case is In re Checking Account Overdraft Litigation, Case No. 09-md-02036, U.S. District Court, Southern District of Florida (Miami).

    I had thousanda in overdraft fees and received a check for 13 dollars!

    Please tell me that it is not to late, pnc did these things to my account so much that when my direct deposit was put into my account more than half came out just to cover the overdraft and late fees, and ATM withdrawal fees. By the time they were done charging all kind of fees, I couldnt pay rent , buy groceries, pay lights and other bills. I always had to play Russian roulette. I was evicted from my apartment.

      They have just recently done the same thing to me, They changed when my charges posted to my account so that they could charge extra over draft fees and took more than half my check. When I called the lady on the phone was showing charges for items I had bought on payday days earlier and we had an argument over it, I had to explain that I had just purchased those items and it was illegal for them to show those items as being purchased before I had purchased them in order to charge a fee. I’d say it’s time for another class action lawsuit.

    Is it too late or is there going to be another lawsuit? PNC is still doing this and they are manipulating charges and leaving stuff in pending for days and days. We had a charge come thru that put our account in the negatives and put money in the account the same day within 2 hours after the charge was through they reordered from high to low put the high charge threw and have left the small charges in pending. I know they are waiting for us to spend another 2 dollars which after that they will bounce all the small charges so I’m stuck in limbo can’t spend any money that we have for fear of them doing the same as they have over an over. I did not know there was a class action lawsuit in place. They have done this for years. This time I was smart enough to print out the statement from the online banking and will do again tomorrow. The small charges in pending have been there since the 29th of April but the large charge that went through on the 30th was put through that night. I will print out another copy tomorrow morning showing a positive balance and will continue to do so every day until it drops down. If you need any of this information for another lawsuit or for me to get in on this one. I am even willing to go to the bank and pay for past statement showing their unfair practices that they have done with us. They will also have charges magically disappear even after they have went from pending to posted, so when you go online to check your balance it shows more then you actually have. This has also been going on for years. PNC needs to be stopped and after a settlement like that you would think that they would stop but no they have continued to do it. Any information you may need please contact me. I have had it with these banks and will do whatever is needed to help put an end to this.

      same type of situation with me.i am closing my account due to there payday loan type of practices.they are still doing the same old after the lawsuit and i hope another one is coming soon.they hold the small checks for days until they can crush you with overdraft fees.
