2011 Crayola Washable Colored Bubbles Class Action Settlement

Crayola Colored BubblesIf you bought Crayola Washable Colored Bubbles, you may have learned the hard way that the colored soap bubbles can stain your hands and clothing, despite advertisements touting that marks left behind will be “temporary and washable.” Luckily for you, a Washington mom took Crayola to court over the alleged false advertising, and a tentative class action lawsuit settlement has been reached.

Mom Alyson Herfert alleges in the Crayola Washable Colored Bubbles class action lawsuit that the labeling and advertising of the bubbles as “washable” simply isn’t true, and that the bubbles stained her personal property. Crayola denies any wrongdoing but has agreed to provide refunds and vouchers to consumers who purchased Crayola Washable Colored Bubbles in 2011, as well as pay for damages caused to clothing and property.

As a result of the Crayola bubble class action settlement, Crayola has discontinued production of 2011 Washable Colored Bubbles and introduced 2012 Colored Bubbles with revised formulas and relabeled packaging that does not describe the bubbles as “washable.”

 
The class action settlement does not include the reformulated 2012 Colored Bubbles currently in distribution.

Class Members of the 2011 Crayola Washable Colored Bubbles settlement include all U.S. consumers who purchased or acquired (including by gift) 2011 Washable Colored Bubbles, through the date of Final Settlement Approval. This includes the following products:

– individual bottles of bubble solution [SKU numbers: 03-7500, 03-7502, 03-7548, 03-7500-0-451, 03-7500-0-441, 03-7500-0-431, 03-7500-0-421, and 03-7500-0-411];
– the “Washable Colored Bubbles Bubble Launcher” [SKU number 03-7300];
– the “Washable Colored Bubbles Wand Set” [SKU number 03-7400];
– the “Washable Colored Bubbles” three-pack [SKU number 03-7503];
– and the “Washable Colored Bubbles Play Pack” [SKU numbers: 03-7601 and 03-7602].

All of these products were distributed at retail in 2011.

Under the terms of the proposed Crayola Washable Colored Bubbles class action settlement, Class Members will receive monetary or voucher benefits depending on the following conditions:

(1) Cash Compensation for Purchase Costs: Class Members with proof of purchase or a UPC will receive their choice of: (i) the cash value of the 2011 Washable Colored Bubbles product(s) (plus any shipping, handling and tax if applicable) in the form of a check; or (ii) Crayola vouchers for the value of the 2011 Washable Colored Bubbles product(s) purchased (plus shipping, handling and tax if applicable), plus $5.00 in vouchers. Compensation or vouchers will not be given to more than one person for the same product. Class Members with no proof of purchase may receive the value of the 2011 Washable Colored Bubbles product(s) purchased in the form of Crayola vouchers not to exceed $12.00.

(2) Cash Compensation for Out-of-Pocket Costs to Clean Stains:
For out-of-pocket costs for cleaning supplies or services to remediate stains caused by 2011 Washable Colored Bubbles, Crayola will provide the cash value of such costs provided that: (i) the Class Member has a receipt or other reliable documentation for a 2011 Washable Colored Bubble product; (ii) the Class Member attests that the stain resulted from the 2011 Washable Colored Bubble product; and (iii) the Class Member provides a receipt or other reliable documentation showing out-of-pocket cost for the cleaning supplies or services.

(3) Cash Compensation for Property Damage: For out-of-pocket costs for cleaning supplies or services to remediate stains caused by 2011 Washable Colored Bubbles, Crayola will provide the cash value of such costs provided that: (i) the Class Member has a receipt or other reliable documentation for a 2011 Washable Colored Bubble product; (ii) the Class Member attests that the stain resulted from the 2011 Washable Colored Bubble product; and (iii) the Class Member provides a receipt or other reliable documentation showing out-of-pocket cost for the cleaning supplies or services.

If the Court approves the Crayola Washable Colored Bubbles class action settlement, you must call Crayola at 1-866-436-6933 between April 24, 2012 and December 31, 2012 to request the settlement benefits. Do not contact Crayola before April because the class action settlement will not yet be in effect.

    When people become complacent about ‘bad’ products, it just leads to more bad products and more complacency over bigger issues with companies believing that they can ‘get away with it’ time and again… Crayola should be ashamed of knowingly putting out a product they knew would stain and cause havoc in households, openly lying to the public about its product in a tv commercial. As a mother, buying a product like this should bring joy to everyone and this did the opposite. Consumers should not have to pay for the mistakes of brands. The days of false advertising are numbered. Be warned.

    I am being evicted because this product got all over my balcony! Now have to pay a bunch of fees in damages! I don’t have a job and no money. So this just screwed me. Now me and my son are homeless!

    Everyone wants to take big companies to court for a little cash, all the time. I think court should be reserved for crimes or deaths and such. But for some lady thats too lazy to clean? Heck, my kids had the same batch of bubbles and it stained the daylights out of my white concrete porch, but all it takes is some good ol’ scrubbing and patience. As for clothes such as whites, thats what setting and soaking is for. Crayola
    didnt do anything wrong, its just that some people expect washable to mean “comes right out with water and gentle command”. This is nothing to sue a conpany over. Unless her property was so severely damaged to unfixable extent or if her or her family were hurt or killed by the stain, then she has no business in that court room.””
