Deadlines Loom for Pinot Noir, AT&T DSL Class Action Settlements

class action lawsuit settlementThe deadlines to file a claim for the Pinot Noir class action settlement and AT&T DSL speed class action settlement are quickly approaching. If you haven’t filed a claim yet, we suggest you do now. Here’s a little background on the cases to get you started.

French Pinot Noir Class Action Lawsuit Settlement

The Pinot Noir settlement will resolve a class action lawsuit, entitled Zeller v. E. & J. Gallo Winery, et al., and Constellation Brands, Inc., et al., that alleges some French winemakers and a U.S. importer sold millions of bottles of fake Pinot Noir to the United States. The class action lawsuit was filed after a French court convicted 12 French winemakers in 2010 of purposely mislabeling cheap wine under the false label of Pinot Noir for at least three years and importing it to the U.S.

Class Members of the Pinot Noir class action settlement include consumers who purchased certain bottles of Farallon, Red Bicyclette, Redwood Creek, Rex Goliath, Talus, Turning Leaf or Woodbridge by Robert Mondavi brand French Pinot Noir wines before December 2, 2011.

Class Members have until May 24, 2012 to file a claim to receive a full reimbursement of the price they paid for the wine, excluding taxes, if they have proof of purchase. Class Members without proof of purchase can still file a claim to receive $3.50 per bottle purchased, up to a maximum of $10.50.

AT&T DSL Speed Class Action Lawsuit Settlement

 

The AT&T DSL speed settlement will resolve a class action lawsuit, entitled Schmidt v. AT&T and SBC Internet Services, Inc., alleging AT&T failed to deliver DSL service to its customers at the speeds promised. Specifically, the class action lawsuit alleges that AT&T breached its contract with and defrauded some of its customers by limiting the maximum data speed that some customers could obtain to a rate below the maximum rate for the plan the customer purchased. It also claims AT&T delivered speeds lower than the minimum promised under the customer’s plan, or otherwise disappointed its customers’ expectations regarding the speed of the DSL Service.

Class Members of the AT&T DSL speed class action settlement include current and former customers of AT&T who paid for DSL service from AT&T or a related affiliate between March 31, 1994 and January 27, 2012.

Class Members have until May 31, 2012 to file a claim to receive a partial refund of the charges they paid during the class period.
