Honda Civic class action lawsuitA federal class action lawsuit claims that 2008-2010 Honda Accords have “a systematic design defect that enables oil to enter into the engine’s combustion chamber.” The defect causes excessive oil consumption, premature spark plug degradation and engine malfunction, the lawsuit says.The Honda Accord class action lawsuit says the systematic design defect may be the result of numerous things, including a material defect, workmanship of the vehicles’ valve guide seals or piston rings, or a flaw in Honda’s VTECT variable engine-timing system.

“Hundreds of complaints concerning this defect appear online, including at least 130 complaints on www.carcomplaints.com referencing the 2008 Accord alone. Numerous complaints are available on other websites too, including the complaints forum of the National Highway Traffic Safety Administration (‘NHTSA’),” the Accord oil defect class action lawsuit says.

The Plaintiffs allege Honda has known about the Accord oil defect for a long time, but continues to actively conceal the defect from consumers and deny there is a known problem.

As a result, the Accord oil defect forces consumers to constantly monitor oil levels in their vehicles and, worse, replace the oil at a rate “far exceeding their reasonable expectations and will eventually incur bills for repairs of components damaged by the oil’s corrosive byproducts.” Furthermore, the class action lawsuit continues, the defect causes “premature fouling” and requires the replacement of spark plugs – further costs incurred by the vehicle’s owner.

The Honda Accord class action lawsuit is brought on behalf of all current and former owners and lessees of a 2008, 2009, or 2010 Honda Accord vehicle who paid for a repair related to the defect or for oil replacements beyond what a reasonable consumer would expect.

The lawsuit is seeking damages, restitution and injunctive relief for violations of the Consumers Legal Remedies Act, the Unfair Competition Law, the Magnuson-Moss Warranty Act, and for breach of express warranty.

The case is Alex Soto, et al. v. American Honda Motor Co., Inc., Case No. 12-cv-1377, U.S. District Court, Northern District of California.

    2010 HONDA ACCORD V6 EX-L prior to purchasing in 2017, the recall related to this class action suit had been completed by original owner in 2016. Currently have engine misfire in cylinder 3, excessive oil burning, oil in cylinder 3 and now #2 after numerous attempts to correct this issue, i.e valve gasket replacement, plug gasket, new spark plugs, new coil packs we started loosing a quart of oil every 700 miles. I replaced 5 quarts within 3 months of an oil change!! Currently in the shop again for a recheck and repair shop says it is exhibiting the same symptoms of the recall. Contacted American Honda Motors and of course they do not perform recall repairs a second time and the original recall repair only had a 12 month/12,000 mile warranty. I am not interested in paying out of pocket for a manufacturer known defect. Most forums state it has to do with the VCM (eco-boost). I had hoped this car would last like most Honda’s used to in the past and pass it down to my daughter. It only has 144,000 miles on it and was well maintained.

      Yes I have a 2010 Honda Crosstour and it has 129,000 I have not had it a year and it just started started burning all like crazy within the last three weeks. For example, I put in 5 quarts is going on the second week and my engine needs four more quarts in there. I am lost for words I just don’t know what to do. Any advice would be appreciated.

        I have a 2010. Honda Crosstour only had it for not even a year and it’s burning 5 quarts within a two week span. I was rereading what I wrote on my last comment I was so mad writing it so many typos.😳🤦🏽‍♀️🤷🏽‍♀️ but if someone can tell me what I can do please‼️‼️‼️‼️‼️‼️‼️

      I have a 2010 V6 and have 60k miles on it. Yes, that’s low…bought it off my dad who never drove it. Well about a month ago the number 3 plug had to be replaced and I keep adding a quart like every other month.

    My sister bought me an accord V6 a few years ago, being a single mother and having owned previous Honda’s I was set on getting just that for reliability and longevity. With a one income family, if something breaks I have to fix it I cannot afford to pay someone else. Since having this 8th generation accord, I have purchased enough parts to exceed the original purchase amount, and that is just for the parts. I have installed all of them on my own time with my own hands. I literally have been under this car more than I’ve been in it. I’m at around 140k miles now and it has been a fight to make it this far. I’ve had to work side jobs and sell items to purchase parts for the vehicle nonstop. But I had no other option at the time. And now I’m looking it’s death in the face because the piston ring issue and it’s no longer a fouled plug or gasket…all the suspension is even brand new from all the pre.ature wear, I’ve had the entire ac system replaced $1700 in parts, not labor. My account at O’Reilly’s gets jaw dropping reactions from any employee that looks up a part for me. I now have significant amounts of oil dumping into the tube wells. I missed out on the first eight years of free spark plugs buying it used for a fairer price, but all the free spark plugs in the world couldn’t save me now. I’ve got about $500 worth of bad ones in a bag in my trunk right now. What gets me is that I worked three years of high school at the local grocer mad saved to buy my first car cash. A 1990 accord lx, brown, one owner, 60k miles, garage kept for $3750. I was torn between that and a completely redone ’86 tee top Camaro…but my responsible decision paid off. I feel like I’ve been cheated with this one. They say when life gives you lemons make lemonade….

    About 3 months ago I was driving my 2010 Honda Accord V6 and the check engine light came on ( blinking) and my car began to misfire. My car has 125,000 miles on it and is maintained on a regular basis. I had my car towed to my local Honda dealership. They informed me that cylinder 3 is misfiring. They replaced spark plugs . To diagnose And replace spark plugs was 600.00. Dealership told me I need to replace pistons at a time of 3,000.00. I have been monitoring my oil and have discovered I am burning a quart of oil every 800.00 miles. Honda is very aware of this issue, dealership acknowledged it. I could go on and on. I am so disappointed in Honda, this is my 3 Honda and this car is a disappointment.. This issue needs a intervention from an attorney

      I had the same problem I went back and forth with Honda not the dealership for over 8 months they made me change all the spark plug 7k miles later it did the same thing finally they said they will fix it for free I paid $100 for 1 year warranty this was 2020 car still runs great. Don’t give up make Honda pay for its mistakes was not easy though.

    My 08 accord ex-l 2.4L would burn a little over a quart of oil every 1,000 miles or so.. i would do regular maintenance every 3,000 miles. I just recently had a severe misfire that I couldn’t figure out since my scanner read codes for maf and iat sensor. It turns out my two of my exhaust valves were somehow damaged resulting in zero compression. It’s in the shop right now and I’m looking at $1,400 in repairs. I bought the car 20,000 miles ago and it now has 161,000. I guess the person that sold it to me knew what he was doing.

    I have a 2008 accord V 6 with same spark plug issues , misfire , oil fouled . It began in 2010 with 19,000 miles with mis fire # 2 cylinder, bad . Plug replaced , reset computer .
    In 2019 with now 93,000 miles .. misfire again of plugs, oil fouled. Had to replace all plugs, 6,000 miles later same issue, Mia fire bad plugs. Replaced again . Was not aware of the class action suit for the piston ring issues. Call Honda , they stated yes we have the campaign for this issue. Unlimited miles and 8 years on the campaign Brought the car in today . Now they say that Because my car as the original owner was in service at 2008 I am out of luck because I had up to 2016 to fix the issue. I have less than 100,000 miles , no letter sent from Honda about this and now they want $3,000 to do the work. Sorry , we can’t help you , not even to offer any assistance as a loyal customer. Thus should have been done in 2010 … the brand disappoints as I now see from all these complaints .
    This makes me so angry especially during this Covid time and no job.

    I just purchased a 2010 Accord EX-L from a Ford dealership. Drove it to work (about 90 miles from dealership)… no problems. But on my 45 minute drive home, the engine light came on!! Agghhhh Good thing I have an appointment in the morning to find out what the problem is. I don’t know a mechanic and wish I would have brought one with me to inspect this vehicle, but it was being sold at a reputable dealership-Ford. Go figure.

    I have had my Honda since new and it is a 2008 Accord. Like others of you, they say I pass the “oil consumption test but for 2500.00 they will fix the oil leak”. REALLY!! This is pure deceptive trade as far as I am concerned. So I have had to live with this problem and still add oil to this car regularly. I have searched for a class action for the 4 cylinders but only found one for 6 cylinders. I am now wanting an attorney that will take my case. Any suggestions?? I live in Houston, TX.

        I have a 09 honda accord with 80000 miles and ive started noticing that it was using more oil then it should. I got my oil change 1,600 miles ago and i had to add 2 quarts to it today. After reading all these stories im shocked and convinced that this is a huge problem for honda. I didnt have this vehicle when the class lawsuit was happening. What happens to us who may have gotten the car recently. This is unbelievable.

          I love my 2008 V6 coupe but after years oil consumption and leaks replacement of oil valve spool, oil cover and gaskets, now it’s coil packs more misfires 3, 4 and 2 more all over 2,000 in repairs; camshaft cradle alternator evaporator AC, more than 10k in repairs over 7 yrs.

      Got a 2010 Honda Accord EXL v6 131,000 miles check engine came on ! Oil consumption problem! I never got a notice on they warranty! Want to charge me $4000 to replace piston rings that what cause the misfire!

        I had the same problem I was back and forth with Honda not the dealer though for about 8 months and the finally fixed it for free and gave me 1 year warranty for $100 this was 2020 car runs good

    I have a 2017 Honda Accord my car completely stopped with NO warning lights and now Jonda says my I have s blown engine because of a hairline fracture to the oil pan and is disputing covering the repair on my power train warranty. Said I hit a pothole but no potholes around my area. I do all interstate driving. They also said all my oil was drained out which is a complete lie because I took pictures of all fluids. Then said I had to have oil in my driveway which there is no oil whatsoever in my driveway or when the vehicle halted. I think they are trying to take advantage of me because they think I am an uninformed woman …advise?

      Honda, despite it’s great reputation, is actually become quite a horrible company. My 2010 Accord developed the “sticky piston, excessive oil consumption” problem covered by this law suit. Protocol is for Honda to check the oil and check again after 1000 miles, so I had my oil changed at a local service station, then brought it in to my local Long Island, N.Y. Honda dealership. To my surprise they insisted that THEY must do an oil change. I had to no choice but to allow them to change the oil again. 300 miles later I checked the oil and realized why they insisted. The oil was OVERFILLED so high that you couldn’t get a reading on the dipstick! I contacted Honda corporate, brought it back to the dealership, where, they tried to accuse me of ADDING OIL !! They corrected the oil level, and 1000 miles later confirmed that my car was experiencing the problem covered by the law suit and extended warranty.
      Note that they also did a multi-point inspection and indicated no other problems.

      Since this dealership was clearly incompetent, or dishonest, or more likely, both, I asked Honda corporate to suggest another dealership to do the repair….which is supposed to take about 3 days according to Honda’s service bulletin. On their suggestion I brought my car to Honda of New Rochelle. They would not give me a loaner car, and took SEVENTEEN DAYS to complete the repair. They covered about half the cost of a car rental, leaving me with an additional $376 expense. They returned the car with the power steering broken, and bad vibration when idling. I brought it back for their review, and only then did they claim that the power steering was broken when I brought it in the first time, despite the fact that they never mentioned it, and it was not indicated on the recent multi-point inspection done at the first dealership! And they said the excessive vibration is normal! They refused to fix the power steering that THEY BROKE!!!

      Pretty horrible story, right? But it gets worse!!

      This car was purchased at Huntington Honda, Long Island NY, as a CERTIFIED used Honda. The car had two small dings, one on the hood less than the size of a dime, and another longer dent under one of the doors. It struck me as odd that they hadn’t fixed them prior to offering the vehicle for sale. At the last moment they asked me to initial a “cosmetic as-is” waiver on the bill of sale. I am normally more astute, but they got me at a weak moment, I figured this was just about the 2 little dings, and after all it was a HONDA CERTIFIED vehicle, which means NO MAJOR ACCIDENTS, AND they valued the car, in writing, at a number that did not reflect major body work. Nevertheless, when the oil problem started, requiring frequent oil level checks I noticed that the paint was peeling on the side panels next to the hood, on both sides. Upon further examination, and confirmation by an employee at the local Honda dealership, it has become apparent that this vehicle had major, major body work done! So even on my initial purchase I was DEFRAUDED!!

      I don’t give up easily, and I’m not done with my battle. Every time I see someone in the same model Honda Accord I share my story. Since I am retired and have lots of time on my hands, and a strong believe the fighting back is the only way to get justice this will become my “hobby”. After all the extended warranty on the oil defect was only offered because someone else took the time to fight back! Eventually the general public will realize that Honda Corporation, like so many other companies has become a horrible company, interested only in short term profits, cheating customers every chance they get!

      DO NOT BUY A HONDA on Long Island or in New Rochelle!!

      DO NOT BUY A HONDA AT ALL!

        Same thing is happening to me now but I always pass the oil consumption test. They claim that my car is burning the normal amount of oil. My car makes all kinds of noises and the oil light comes on and off every day. I’ve added almost two quarts since my last oil change.

          Document EVERYTHING! Take photos! Contact Honda Corporate. Contact the legal firm that “supervises” this class action suit (you can find their name and number in the settlement papers.)

          And post your problem EVERYWHERE for two reasons. First to pressure Honda to step up and resolve your problem, and second, to let as many Honda owners and prospective owners as possible know that Honda is NOT a quality company!

        I have a 2010 Honda Accord EX-L v6 which i got through CarMax. I think something is o untold about the vehicle. There’s a different shade of grey o be the driver side door and the alarm would go off multiple times after engaging with the remote. Funny business. You bet. I’ve had so many repairs but the major ones now are catalytic converters,. Bad lifter is what I’m assuming. Powertrain issues. And battery drainage leaving me trip jump start after leaving anything on for over a minute. I know there’s many recalls for this car even for repairs i already paid for. How can i get recompensated and where would i get information about recalls or options availability so i can stop doing repairs myself.
