Verizon TV Protection Plan Class Action Lawsuit

VerizonA federal class action lawsuit claims Verizon sold a TV Protection Plan that promised subscribers with screens larger than 32 inches that they would not have to pay the $75 fee for service calls, yet Verizon refuses to make service calls unless they pay for it.

The Verizon TV Protection Plan class action lawsuit is seeking monetary damages and injunctive relief for consumer fraud, legal fraud, equitable fraud and breach of contract.

“The terms of the TV Protection Plan specifically excluded subscribers with televisions larger than 32 inches from having to pay a $75 service fee. Yet, Verizon refused to have any subscribers with televisions larger than 32 inches, such as the Plaintiff, get service unless the service fee was paid,” the Verizon TV Protection Plan class action lawsuit states.

“Verizon knew subscribers would have no choice but to pay for the service despite the terms of the TV Protection Plan. For each such act, Verizon committed consumer fraud and breached the terms of its own agreement,” the class action lawsuit states, adding that Verizon never complied with, “nor had any intention of complying with” the terms and conditions of the protection plan.

The Verizon TV Protection Plan class action lawsuit is brought on behalf of a nationwide class of all subscribers to the TV Protection Plan that had at least one television larger than 32 inches covered under the plan during time period the “Terms and Conditions for TV Protection Plan” were applicable. It is also seeking to represent a Subclass of all subscribers who paid a service fee for service for any such television during the same time period.

The Verizon TV Protection Plan class action lawsuit is asking that Class Members receive full refunds for any money they spent for enrollment in the TV Protection Plan, a refund of service fees charged, attorneys’ fees, court costs, and other relief deemed proper.
