Washington University DPPA Class Action Settlement

Washington UniversityWashington University has reached a class action lawsuit settlement over allegations it violated the Driver’s Privacy Protection Act (DPPA) by acquiring a database of information from the Missouri Department of Revenue that contained personal information such as Social Security Numbers of licensed drivers in Missouri.

According to the Washington University DPPA class action lawsuit, entitled Johnson v. Washington University, the University violated the DPPA by acquiring a database of information from the Missouri Department of Revenue that contained “personal information” and “highly restricted personal information” of all licensed drivers in the State of Missouri. This information included such things as their Social Security Number, full name, home address, date of birth, make and model of vehicle, and more. The class action lawsuit argued that Federal law prohibits Washington University from obtaining this personal information without the individuals’ express consent and for a purpose not permitted under the statute.

Washington University denies any wrongdoing but has agreed to end litigation by establishing a class action lawsuit settlement that will provide incentive awards of $500 to each of the named class representatives, and up to $25,000 in class counsel’s attorneys’ fees and costs.

The Washington University DPPA class action settlement does not provide any monetary benefit to Missouri drivers, but it does promise that within 25 business days after the judgment becomes final, Washington University will delete Social Security Numbers from the Missouri DOR Database. It also promises that it has conducted an investigation and concluded that no Social Security Numbers have been disclosed or otherwise made available by the University to third parties.

A Final Approval Hearing on the Johnson v. Washington University class action settlement will be held November 28, 2011.
