Hurd Inert Gas-Filled Window Class Action Settlement

windowHurd Millwork Company, Inc. has reached a class action lawsuit settlement over allegedly defective inert gas-filled insulated glass windows and doors. If you own a home or property with Hurd inert gas-filled windows and/or doors, you may be eligible to receive a partial refund of the purchase price you paid.

The Hurd window settlement will resolve a 2004 class action lawsuit, entitled Douglas Barden v. Hurd Millwork Company, Inc., that alleged the inert gas-filled insulated glass windows and doors manufactured by Hurd did not retain the inert gas and allowed the gas to leak out over time, thus, reducing their thermal rating and efficiency. Hurd denies any wrongdoing, but has agreed to provide a $1.65 million class action settlement fund to resolve the litigation.

Under the Hurd inert gas-filled window class action settlement, Class Members who file a valid and timely claim form can receive a prorated distribution of the class action settlement, up to a 12 percent return of the purchase price of their Hurd inert gas-filled insulated window and door products.

Class Members of the Hurd window class action settlement include all current owners of property located in the following states whose homes, condominiums, apartment or commercial building have inert gas-filled insulated window and door products manufactured by Hurd between January 1, 1994 and December 31, 1998:

Connecticut
Georgia
Indiana
Kansas,
Kentucky
Louisiana
Maryland
Massachusetts
Missouri
Nebraska
New Jersey
New York
North Carolina
Ohio
Oklahoma
Pennsylvania
Vermont
Virginia
West Virginia
Wisconsin
District of Columbia

To participate in the Hurd inert gas-filled window settlement, you must submit a valid claim form to the Settlement Administrator no later than February 10, 2012. The deadline to exclude yourself from the class action settlement is November 23, 2011.

    I install 4 Herd exterior Full Glass Doors in my house in 2007. They are leaky gas from between the glass. Did not here about a settlement until I got on the computer.

    I have several HURD windows with failed seals. I never heard anything about a class action lawsuit. I only found this info while trying trying to find a dealer to replace a screen.

    Is it too late for compensation? We never received notice of this class action. Our windows and doors were purchased and installed in 1997 in Louisiana. They have over the years all failed and the wood has rotted. We’ve been trying to find repair or replacement options for years but all are cost prohibitive. The former Hurd dealer here is not of any real help with the Hurd bankruptcy and sale. Any advice would be appreciated.

    I built a house in 2003 and spent close to $40,000 on Hurd windows. The seals were failing and they would replace. Then they said they would not warranty the windows any longer. I have 13 defective windows now, some of which I paid to replace already. I did not know about any class action suit. What are my options of recourse?

      I installed a couple dozen Hurd windows in my in 2000. Several have failed. Do I have any way of recovering my loss?

    Our house was built in 1993. After several windows shattered which were covered under limited warranty they send a technician who indicated that all the windows were defective. Holes were drilled in them and sealed. I run a business and was raising a family, as soon as the windows were replaced I moved on to the next fire. For some reason I was reminded of this today and upon an internet search became aware of the class action law suit. Why were homeowners such as myself not informed? I spent $20,000 on Hurd windows at that time. Below I have attached an email sent to Hurd today: In 1993 after researching windows for construction of my home I chose Hurd windows as they claimed to have the highest R value of any window in the industry at the time. I wanted to build a home that was highly energy efficient and I chose Hurd with that in mind from the information that had been provided to me. A number of years ago several of my windows shattered. When this happened the first time I was told the window was under a limited warranty and I would have to partially pay for it’s replacement. When the second or third window shattered I was told it would be replaced and Hurd sent a technician to my home who indicated that the all my windows had a significant vacuum due to the neutralization of the argon molecules from sunlight. He then drilled holes into all the windows and sealed the holes. For whatever reason I remembered this today and out of curiosity googled Hurd only to find out that your company was sued for this same reason in a class action law suit several years ago. I am confused as to why I was never contacted regarding this suit. I plan on contacting the legal firm that represented the claimants and will do everything in my power to enlighten consumers as to your deception. I believed in Hurd and wanted to keep my business local, what a disappointment you have brought to me that I will convey to the public with every breath I take…..Jim Geraets

      It’s heartbreaking. We just purchased our dream home not noticing the windows were shit. Now we will have to replace all the windows. The box has yellowed and looks ridiculous. I’m very disappointed to know that these that these windows were once thought of to be the best! Ugh! Everyone just wants a buck at anyone’s expense. It’s sick and saddening. My husband and I work a lot and coach and I sub plus run a business. It’s sooo frustrating what people are out there selling!

    We built our house in 1995 and we had over 12 windows explode in our house. A rep came out after months of contacting them and said the gas leaked out. They replace them a few years ago and the ones they replaced hAve a green tint up them. Now last night I had more explode that they did not replace. It sounds like a gunshot. I’m thinking if they have a default in their product they should have to replace them all. Help!!!
