By Sarah Pierce

Visa prepaid debit cardVisa has reached an $18 million class action lawsuit settlement for illegally recording customer service telephone calls without notifying the callers. As a result, some prepaid Visa debit card customers living in California, Florida, Maryland, Nevada, New Hampshire or Washington can file a claim to receive cash benefits from the class action settlement.

The Visa settlement will resolve a class action lawsuit, entitled Marenco v. Visa, Inc., that alleges Visa violated certain statutes in California, Florida, Maryland, Nevada, New Hampshire and Washington by recording customer service phone conversations without providing notice to or obtaining consent of all parties.

Class Members of the Visa call recording settlement include all persons who (i) called any Affected Phone Line prior to October 1, 2010 and spoke with a live person, and (ii) at the time of the call resided in or were located in California, Florida, Maryland, Nevada, New Hampshire or Washington. The Affected Phone Lines are customer service numbers for some kinds of prepaid Visa debit cards. You can determine if you’re a Class Member of the Visa class action settlement by looking at the back of your prepaid Visa debit card or checking your telephone records to see if one of the numbers listed here is provided.

Under the Visa call recording class action settlement, Class Members who file a valid claim form before the deadline of October 19, 2011 will receive an equal share of the remaining $18 million class action settlement fund after all expenses have been paid out. The maximum that Class Members living in California will receive is $5,000, while the maximum that Class Members living in the other five states will receive is $1,000.
