DuPont Imprelis Herbicide Class Action Lawsuit

A federal class action lawsuit claims DuPont sells Imprelis herbicide to kill broadleaf weeds, but it also kills spruce, pines and other evergreens, costing customers “millions of dollars” nationwide.
The DuPont herbicide class action lawsuit says that since Imprelis hit the market in 2010, it has been advertised, marketed and sold to consumers as an environment-friendly herbicide that kills broadleaf weeds. However, “reports of sudden and disastrous side effects quickly followed,” the class action lawsuit says.
Within weeks of using Imprelis, “lethal damage to mature landscape trees, particularly Norway and Colorado spruce, white pines, and other evergreens” occurred and became widespread across several states. DuPont began investigation reports of these symptoms on June 17, 2011, and issued a warning not to apply Imprelis where Norway Spruce or White Pine are present on, or in close proximity to, the property to be treated.
The Imprelis warning is too little, too late, says the DuPont class action lawsuit.
“According to an investigation published by the Detroit Free Press on July 11, 2011, damages from tree deaths from coast to coast are projected to be in the millions of dollars. Meanwhile, the damage to the Plaintiffs, the Michigan Class (as defined below), and the National Class (as defined below) as a result of the injury from Defendant is mounting with no end in sight, causing the EPA to investigate the possible link to Imprelis.”
The DuPont Imprelis class action lawsuit is brought on behalf all Michigan consumers and National consumers who purchased and/or paid all or part of the purchase price of Imprelis and whose land was treated with one or more applications of Imprelis during the period October 4, 2010 through the present. It is seeking restitution, damages and other monetary relief from DuPont for Consumer Fraud, Unjust Enrichment, Negligence, Product Liability and Damage to Land.

The case is Washtenaw Acquisition, LLC et al. v. E.I. Du Pont De Nemours and Company, Case No. 1:99-mc-099999, United States District Court, District of Delaware.

    Injury is an absurdity. The trees are dead conifers and deciduous and even my grass. Guess what – my weeds are doing well. I am so sick about this I have 5 40′ pines, 2 ornamental shrubs, oak and maiden hair tress all dying or dead. My neighbors house has 40′ blue spruces all absolutely brown. These trees are 30-40 years old!
