IPEX Kitec Plumbing Class Action Lawsuit Settlement

IPEX logoDoes your home or a building you own contain Kitec plumbing manufactured by IPEX? It may be worth checking, because thousands of homeowners across the United States and Canada will be able to share in a proposed $125 million class action lawsuit settlement over allegations that the Kitec Plumbing Systems are defective. 

 

The proposed IPEX Kitec Plumbing class action settlement will resolve several class action lawsuits filed in the U.S. and Canada (collectively called In Re: Kitec Plumbing System Products Liability Litigation) that allege IPEX manufactured defective Kitec plumbing systems that prematurely fail, resulting in leaks or damage to the structures they’re installed in. 

 

The Kitec class action settlement includes all persons that own, have owned, lease, or have leased a building, home, residence or any other structure in the United States and Canada that contains, or at any time contained, a Kitec Plumbing System (which may consist of components, individual parts, or as a system, PEX-AL-PEX, PE-AL-PE, PERT-AL-PERT, PEX pipe, valves, fittings).

 

You can see photos of the Kitec Systems here. There are also several ways to tell if you have a defective IPEX Kitec Plumbing System installed:

 

(1) The Kitec pipe is typically blue in color for cold water applications and orange in color for hot water applications.

(2) The pipe is usually marked with one of the following brand names: Kitec, PlumbBetter, IPEX AQUA, WarmRite, Kitec XPA, AmbioComfort, XPA, KERR Controls or Plomberie Améliorée.

(3) Where the fittings are visible look for the words Kitec or KTC on them. The terms CSA B137.9/10 or ATSM F1974 could also indicate that you have a Kitec system.

(4) Often, the best places to look for the Kitec system is near the hot water tank or in the mechanical room where the pipe is connected to or exits the walls. Also look under kitchen sinks or bathroom vanities, where the pipe and/or fitting exits the wall.

 

If approved, the IPEX class action lawsuit settlement will allow Class Members to share in the $125 million settlement to help pay for the repair of buildings, residences, homes or other structures plumbed with the defective Kitec Systems. The amount of compensation you will receive will depend on a number of factors, including the type and the cost of any property damage incurred.

 

To be eligible to receive compensation from the Kitec settlement, you must complete and submit a valid Claim Form within 8 years after the Effective Date. As of now, the estimated deadline is January 20, 2020. (Keep checking the Settlement Administrator’s website at www.KitecSettlement.com for updates.)

 

If you wish to exclude yourself from the Kitec settlement and retain your right to sue individually, you must submit your request by September 30, 2011.

    I am a 73 year old veteran and I purchased this home in 8/22/2017 and in around 2020 I had 6-10 tears in the orange hoses. This caused water damage of 15000 gallons of water in the home. To this date I still don’t have my floors and base boards or sinks lines repaired or replaced due to financial conditions. Had I known about this claim I would have been eligible to summit a claim.

    This is not the first time I notified this company. I did notified this company as soon as I heard about there being a claim. But I was told there was nothing they could due because the claim had already closed.

    I know there are many people like my self that are in the same position. I feel this claim was not really available to the public to really know how bad this product can really be to homes like mine. I also feel that they closed this claim to early for people to receive help from this company.
    I feel someone should look into the true damage these products have caused other customers.

    Also at the time I notified Kitec-plumbing and the lawsuit was closed the amount of money left over in the Kitec funds were far greater in the companies favor and was far more then what they settled for. There were many dollars left over that could have helped many more people like myself.

    To this day I have had no response from Kitec-plumbing company!

    My house was built in 2007 we bought home in October of 2018. While doing a master bathroom remodel noticed a small drip/leak around a 3/4 inch hot water line which is mentioned in this class action lawsuit..I knew nothing about this defective piping until I researched fittings to try and repair which obviously is discontinued..the whole house is plumbed with this defective pipe/ fittings…deadline to file a claim was Jan 9th 2021. What should I or can I do in this situation. Or what would you do if you were in this situation. Looking for a solution to my problem with this defective material.

    Kitec Plumbing systems are a costly nightmare. Its been over 2yrs since I submitted a claim in this settlement for reimbursement to replace my kitec plumbing system after it sprung 3 separate leaks and caused almost $20k in water damage that resulted in black mold growth and other problems. I called in 6 months after i submitted my claim to check on the status, the representative says there are no deficiencies on my claim and that she didnt know why there was a delay, 2 wks after that call i got a letter in the mail requesting a copy of my lease and a tax form i had already filled out as part of the claim package so i sent it all back i the next day. 2 mos later, i called again to inquire about my claim status, i got a relay, there were no deficiencies on my claim and that as soon as the class counsel gives them the go ahead to distribute the next round of claim payments, they would do so. AFTER AN ENTIRE YEAR HAS PASSED and numerous calls to the call center and emailing back and forth with the case team informing me i had no deficiencies,on my claim, i get a letter in the mail requesting me to revise my claim by separating the actual cost of replacement from the damages caused by the leaky system to get a payment. i sent my reply with the revised amounts by email the same day to the case team, no response until 6 mos later (June 2017) they sent by mail the SAME EXACT LETTER AGAIN, requesting the costs for replacing my system only, i sent in again the same information the requested before, i call in at the beginning of this month (September 2017) the rep told me they still have updated my claim reflecting the information sent in. WTH is going on? is there anyone else who submitted a claim in this settlement who had the same problem or an atty who can help me with this? i have all saved emails back and forth with the case team and i believe they keep a record of calls into the settlement center.
