AT&T Unpaid Overtime Class Action Settlement

By Sarah Pierce

AT&TAT&T employees who worked for AT&T Operations, Inc. as part of the “Blue Sky” project have won a class action lawsuit settlement concerning unpaid overtime. AT&T has agreed to pay $12.5 million to class members who file valid claims.

The AT&T unpaid overtime class action settlement will resolve allegations in Buccellato v. AT&T that AT&T misclassified certain employees as exempt from the overtime pay requirements of federal and state law, and consequently failed to pay them overtime pay. You’re considered a class member of the AT&T unpaid overtime settlement if you worked for AT&T Operations as part of the “Blue Sky” project anywhere in the U.S. in one of the following positions between February 1, 2008 and February 17, 2011: (1) Business Manager IT, (2) Senior Project/Program Manager IT, (3) Project Manager IT, (4) Senior IT Analyst, (5) Technical Architect, or (6) Technical Design Engineer.

The class action settlement also covers persons who have been moved from one of these positions to a different job title solely as a result of AT&T’s Technical Career Pathways (“TCP”) project. It also covers persons who transferred to the payroll of AT&T Services, Inc., in December 2010, while working in one of these positions.

Class members in the AT&T Blue Sky project unpaid overtime settlement have already been mailed claim forms preprinted with the amount of money they can receive from the settlement. If you believe that the information listed for you on the claim form is incorrect, or you did not receive a claim form and believe that you should have, you should contact the Settlement Administrator at 1-877-236-6518.

Claim forms must be postmarked or received by the Settlement Administrator by fax or e-mail by May 31, 2011 to receive money under the class action settlement.
