Viewers of Top Class Actions are reporting on our Facebook page that they are receiving checks in the mail from the Missouri dog treat class action settlement. One viewer has reportedly received a check for more than $350 from the settlement.
The Missouri dog treat settlement resolves a class action lawsuit (Curts v. Waggin’ Train LLC, et al.) over claims Nestle Purina PetCare Company and Waggin’ Train LLC sold Waggin’ Train and Canyon Creek Ranch dog treats that were contaminated, allegedly causing pets to get sick and/or die. This class action settlement only applies to Missouri residents. A separate nationwide class action settlement is also pending.
Since 2007, the U.S. Food and Drug Administration has been warning consumers about growing reports of pets falling ill after consuming jerky treats that were made in China. The contaminated jerky treats allegedly affect pets’ kidneys, causing symptoms like decreased activity, vomiting, diarrhea, and increased water consumption and urination.
Following the FDA’s warning, numerous class action lawsuits were filed against the manufacturers of Chinese-made dog treats. The FDA announced that Chinese-made jerky treats were linked to the deaths of more than 1,000 dogs.Waggin’ Train and Nestle Purina deny the allegations but agreed to settle the dog treat class action lawsuits to avoid the risk and expense associated with ongoing litigation.
Class Members of the Missouri dog treat settlement include all residents of Missouri who purchased Waggin’ Train or Canyon Creek Ranch brand dog treat products that were either imported from China or which contained any ingredient imported from China. A list of the affected dog treat products can be found here.
Under the terms of the class action settlement, Class Members who filed valid claims by June 5, 2015 would be eligible for a full reimbursement for their purchase(s) of Waggin’ Train and Canyon Creek Ranch dog treat products. Class Members who did not submit documentation supporting their claims were limited to a maximum reimbursement of $300.
